Show PUBLIC NOTICES PAGE A8 SUMMIT COUNTY NEWS NOTICE OF PUBLIC HEARING Loan Authorization September 18, 2012 Dear Sewer User; The Echo Sewer Special Service District, Summit County Utah (the "District") has applied to the Utah Water Quality Board (the "Water Quality Board") for a loan to be used to construct sewer system improvements and related matters. Security for the loan would be provided though the sale of a "nonvoted" taxable sewer revenue bond bearing no interest to the Water Quality Board. The bonds will be issued in a Principal Amount not to exceed $250,000, to bear no interest, to be repaid in 20 annual payments. The financing will also include a hardship grant, not to exceed $251,000, which the District will not be required to repay. Payments on the bond shall be made from the net revenues of the District's sewer system, which will consist of the rights-ofway and other assets of the Echo Sewer Company to be transferred to the District and improvements to be constructed with the bonds and grant. The District proposes to increase sewer rates for all users effective November 1, 2012. This will increase the sewer fee to $45 per month per ERU In this regard, the District invites comments on the sewer project and rate increase (either favorable or negative). The District, with the County Council acting as the Governing Authority of the Distirct, will hold a public hearing on October 3, 2012, at 6:00 p.m. or as soon thereafter as feasible at the Sheldon Richins Building, 1885 West Ute Blvd., Park City, Utah 84098. The District will receive both written and oral comments at that time. Your comments will be considered and if there is significant opposition to the proposed project, the Water Quality Board may require a bond election to obtain the Board's funds. NOTICE OF PUBLIC HEARING AND BONDS TO BE ISSUEDAKFRANCIS CITY, SUMMIT COUNTY, UTAH NOTICE IS HEREBY GIVEN pursuant to the provisions of the Utah Local Government Bonding Act, Title 11, Chapter 14, Utah Code Annotated 1953, as amended, that on September 13, 2012, the City Council (the "Council") of Francis City, Summit County Utah (the "Issuer") adopted a resolution (the "Resolution") in which it authorized the issuance of the Issuer's Sewer Revenue Bonds in one or more series (the "Bonds") in the aggregate principal amount of not to exceed $5,500,000, to bear no interest, to mature in not more than 35 years from their date or dates, and to be sold at a price not less than 99% of the total principal amount thereof. NOTICE IS FURTHER GIVEN that the Issuer called a public hearing for the purpose of inviting public comment on the proposed issuance of the Bonds and the economic impact that the improvements proposed to be financed with the Bonds will have on the pri- vate sector. The public hearing will be held on October 11, 2012, at 7:00 p.m. or as soon thereafter as feasible, at the City Hall located at 2317 South Spring Hollow Road, Francis, Utah. As sewer revenue bonds, no property taxes will be pledged for the Bonds. The Bonds, pursuant to the Resolution and a Final Bond Resolution to be adopted authorizing and confirming the sale of the Bonds for the purpose of financing the construction of additions and improvements to the Issuer's Sewer system and related improvements and paying issuance expenses to be incurred in connection with the issuance and sale of the Bonds. The Bonds are to be issued and sold by the Issuer pursuant to the Resolution, including as part of said Resolution the draft of a Final Bond Resolution which was before the Council and attached to the Resolution in substantially final form at the time of the adoption of the Resolution (collectively, the "Bond Resolutions") and said Final Bond Resolution is to be adopted by the Council in such form and with such changes thereto as shall be approved by the Council upon the adoption thereof; provided that the principal amount, interest rate or rates, maturity, and discount of the Bonds will not exceed the maximums set forth above. A copy of the Bond Resolutions are on file in the office of the City Recorder of the Issuer in the Issuer's offices in Francis, Utah, where they may be examined during regular business hours of the City Recorder from 8:00 a.m. to 4:30 p.m. Monday through Thursday, for a period of at least thirty (30) days from and after the last date of publication of this notice. NOTICE IS FURTHER GIVEN that a period of thirty (30) days from and after the last date of the publication of this notice is provided by law during which any person in interest shall have the right to contest the legality of the Bond Resolutions or the Bonds, or any provision made for the security and payment of the SEPTEMBER 21, 2012 Bonds by filing a verified written complaint in the district court of their county of residence, and that after such time, no one shall have any cause of action to contest the regularity, formality or legality thereof for any cause whatsoever, other than by referendum.
