Voter registration records of Summit County shall be considered by the SCC as conclusive evidence of residency. Any protest made by the owners of the taxable property proposed to be annexed, signed on behalf of a corporation owning such property, shall be sufficient if it is signed by the president, vicepresident, or any duly authorized agent of the corporation. Where title to any property is held in the name of more than one person or corporation, all of the persons or corporations holding title to it must join in the signing of the protest. After conclusion of the hearing and after the time for filing protests has expired, the SCC shall adopt a resolution either annexing the property or determining that the proposal to annex the property should be abandoned. Such resolution PAGE B5 Summit County News may contain any changes from the initial resolution or this Notice of Intention as the Council determines to be appropriate, including a reduction in the amount of the property to be annexed; but the amount of the property to be annexed may not be increased without the giving of a new notice of intention and the holding of a new hearing. As set forth in §17D-1-212, any person who timely filed a written protest against the annexation and who is either a registered voter residing within the area annexed or is an owner of property included within the boundaries annexed may, within thirty (30) days after the adoption of the Resolution annexing the property into the District, file an action in District Court of the Third Judicial District, only upon the grounds, however, that his/her property will not be benefited by the services authorized to be furnished by the District or that the proceedings taken in the establishment of the SSD have not been in compliance with the law. A FAILURE TO FILE AN ACTION WITHIN THE PRESCRIBED TIME SHALL FORECLOSE ALL OWNERS OF PROPERTY OR QUALIFIED VOTERS WITHIN THE PROPOSED DISTRICT SO ESTABLISHED FROM THE RIGHT FURTHER TO OBJECT THERETO. After the adoption of the resolution annexing the property to the District, the boundaries of the District shall be modified to include the property described above, whereupon the property will become an integral part of the District and the owners thereof shall be entitled to receive the benefit of all services provided by the District. If the property is annexed, the District will be authorized to provide oversight and management of any and all waste water facilities within the area proposed for annexation, including but not limited to the establishment of rules promulgated by the Summit County Board of Health to regulate and manage such facilities, the possible future acquisition and/or construction of waste water facilities, systems or improvements to be located within the District, together with necessary appurtenances and equipment therefore. Siddoway “Fritz” Francis Charles “Fritz” Siddoway passed away peacefully at his home, June 4, 2009, in the loving arms of his family whom he loved so much. Fritz was born Sept. 12, 1922, in Rockport, Utah, to Francis (Frank) Armstrong and Mary Andersen Siddoway. Dad grew up on the ranch where he learned the important lessons of life, like hunting, fishing, having fun, and hard work at his father’s side. Due to a long bout of rheumatic fever in his teens, his heart was damaged but he didn’t let that stop him from enjoying life to the max. Fritz married Norma Marcellin in 1950 and later divorced. Dad married Ruby Merlene Long on June 20, 1960. Soon after, they moved to Dugway with Mike and Connie; Alan was born four years later. Dad worked at the Clearfield Naval Depot until 1959, then for the U.S. Army at Dugway as the Commissary Manager until he retired in 1975. They moved back to the ranch at Rockport where he worked at the State Park until 2006. Dad lived a life of honor, love, joy, responsibility, generosity and honest labor…his handshake was his promise. Fritz is preceded in death by his parents; his brothers, Daniel and Benjamin; sisters, Ellen and Nancy; and his best pals, Cecil and Lola Metcalf. He is survived by his wife, Merlene; son, Michael (Cheri); daughter, Connie (Kelly) Whiting; son, Alan (LouDean); daughter, Judy (Farzin) Goran, and sister, Edna Allison; 11 grandchildren and 12 great-grandchildren. Dad enjoyed having his family around him. Funeral Services were held Monday, June 8, at the Old Rockport Church below Rockport Dam. Interment was in the Wanship Cemetery.
