Nebo School District, Utah County, Utah (the ''School District"), at the same time as the special voted leeway election being held in the School District, on Tuesday, June 23, 2009, at which special bond election there shall be submitted to the qualified, registered voters residing within the School District the following question: , PUBLIC NOTICE IS HEREBY GIVEN BOARD OF EDUCATION OF NEBO SCHOOL DISTRICT UTAH COUNTY, UTAH SPECIAL BOND ELECTION NOTICE IS FURTHER GIVEN, that PROPOSITION #1 Shall the Board of Education of Nebo School District, Utah County, Utah,be authorized to issue general obligation bonds in an amount not to exceed $160,000,000 and to mature in no more than 21 years from the date or dates of issuance of such bonds for the purpose of raising money for purchasing one or more school sites, buildings and furnishings and improving existing school property under the charge of the Board of Education, and, to the extent necessary, for providing moneys for the refunding, at or prior to the maturity thereof, of general obligation bonds of the Board authorized hereunder or heretofore issued and now outstanding? Notice of Property Tax Increase Due to Bond Issuance Passage of the proposition means that the tax on a $240,000 residence in the School District would increase $302 per year ($240,000 being the estimated average value of a residence in the School District). The tax on a $240,000 business in the School District would increase $549 per year ($240,000 being the valffe of a business having the same value as the estimated average value of a residence in the School District). If the bond authorization is approved, the Board expects to issue the bonds in such a manner that no increase in the current tax rate for debt service will occur; however, if the bonds are approved and sold, the current tax rate will continue for more years than if the bonds are not approved. The foregoing information is only an estimate of tax increases and is not a limit on the amount of taxes that the Board of Education may be required to levy in order to pay debt service on the bonds. The Board will be obligated to levy taxes without limitation as to rate or amount in order to pay the bonds, as provided by law. The amounts are based on various assumptions and estimates, including estimated debt service on the bonds and taxable values of property in the School District. The special bond election shall be held at polling places located in the voting precincts of Utah County in which qualified voters of the District reside. Applications for absentee ballots for military voters living in the United States must be filed with the Election Officer no later than June 19,2009, the Friday before election day. Military personnel voting an absent^ ballot at the Election Officer's office must apply and cast their ballot no later than Monday, June 22, 2009, the day before election day. Military voters stationed overseas and overseas citizen voters must file an application for absentee ballot with the Election Officer no later than June 3,2009, 20 days before election day. To be valid, an absentee ballot (a) must be clearly postmarked by the appropriate military post office before election day and received in the office of the Election Officer before noon on July 1,2009, the day of the official canvass or (b) the voter has signed an mailing affidavit on the back of the ballot envelope and the ballot is received in the office of the Election Officer before noon on July 1,2009, the day of the official canvass. This test is open to public observation in* accordance with the provisions of Section 20A-3-201, Utah Code Annotated 1953, as amended (the "Utah Code"). NOTICE IS FURTHER GIVEN that on Thursday, June 4,2009, at 9:00 a.m., in the Board Room of the School District office, located at 350 South Main Street, in Spanish Fork, Utah, there will be conducted a test of the automatic tabulating equipment or other apparatus to be used to tabulate the results of the June 23,2009 special bond election to be held in the School District on the issuance of $160,000,000 general obligation bonds described above. This test is open to public observation in accordance with the provisions of Section 20A-4-104, Utah Code. NOTICE IS FURTHER GIVEN that on Wednesday, July 1,2009, that being a day no sooner than 7 days and not later than 14 days after the special bond election, the Board of Education of the School District will meet at its offices at 350 South Main Street, in Spanish Fork, Utah, at 5:00 p.m. and will canvass the returns and declare the results of the special bond election. Pursuant to applicable provisions of Sections 11 -14-208 and 20A-4-403 of the Utah Code, the period allowed for any contest of the special bond election shall end 40 days after July I, 2009 (the date on which the returns of the election are to be canvassed and the results thereof declared). No such contest shall be maintained unless a complaint is filed with the Clerk of the Fourth Judicial District Court in and for Utah County, within the prescribed 40-day period. Voting at the special bond election shall be by electronic ballots and other ballot forms. The ballots will be furnished by the Business Administrator of the Board of Education (the "Board") of the School District (the "Election Officer"), on behalf of the Board, to the poll workers. The poll workers shall furnish such ballots to the qualified electors of the School District. If the bond authorization is approved, the Board expects to issue the bonds in such a manner that no increase in the current tax rate for debt service will occur; however, if the bonds are approved and sold, the current tax rate will continue for more years than if the bonds are not approved. In order to vote at the election, you must present valid voter identification to the poll worker before voting, which must be (a) a valid form of photo identification that shows your name and photograph or (b) two different forms of identification that show your name and current address. The foregoing information is only an estimate of tax increases and is not a limit on the amount of taxes that the Board of Education may be required to levy in order to pay debt service on the bonds. The Board will be obligated to levy taxes without limitation as to rate or amount in order to pay the bonds, as provided by law. The polls at each polling place shall open at 7:00 a.m. and shall remain open until 8:00 p.m., when they will close. There is to be no special registration of voters for the special bond election, and the official register of voters last made or revised shall constitute the register for the special bond election, except that the County Clerk of Utah County (the "County Clerk") shall register any person who on the day of the special bond election will be a qualified elector, as provided by law. The County Clerk will make registration lists or copies of such lists available at each of the above-described polling places for use by registered electors entitled to use such voting place. To vote in favor of the above bond issue, select the box immediately adjacent to the words "FOR THE ISSUANCE OF BONDS." To vote against the bond issue, select the box immediately adjacent to the words "AGAINST THE ISSUANCE OF BONDS."
