AND CfTY COUNCIL; I pride myseif in being a citizen of Beaver City, the State of Utah and the good old U.S.A. I am troubled by big government dictating to us what they think is best for us and then forcing us to follow these mandates or suffer the consequences. It is even more troubling when we see the ones making and enforcing the (laws), not following the laws themselves. It's not only big government doing this- \-find that it's being done in our own city government. I would like to give you some examples of what I am saying. These are real, actual examples from the citizens of our own community. I am withholding the actual names to protect the privacy of these people. Example #1 - Citizen "An was watering a few dry spots in his lawn last summer with a hose attached to a pipe on his side of the city's pressurized irrigation system. Someone from the city office came by, saw what he was doing, and told "A" he was breaking the law and could be cited for it. Then citizen "A" put a sprinkler attachment on his hose and then asked how that was. The one from the city then said you are now in compliance with the law. Example #2 - Citizen "B" About 4 summers ago Citizen "B" read the City Ordinance on city water use in the Beaver Press. "B" wanting to be in compliance with the city laws went to the city office and asked about this ordinance. "B" was toid that as long as he had a 3/4 inch hose attached to his side of the pressurized irrigation system, he was in compliance with the ordinance. A summer later this same ordinance appeared in the Beaver Press. In a nutshell this ordinance says there shall be no open discharge of water from the pressurized irrigation system (no open furrow watering, no watering from a hose of any size by open discharge, in other words you must have a sprinkler attached to the end of the hose). Citizen " C read this write up from the city and being a good citizen and wanting to be in. compliance with the law, spent many hours (even though he didn't want to, and because of ill health), and also spent much money, putting in a sprinkling system for his garden. From his own gardening, experience he knew there were many disadvantages in using only a sprinkling system for this kind of garden. Citizens of Beaver City, my concerns are these: (a) The city council has v enacted ordinance about water use to help us through dry summers. This is good, however, they have jumped into this without giving (t serious though, and without the facts to back up their good intentions (b) The city's own people interpret these ordinances differently, and I find all city workers (Mayor, Council Members and Employers, or in violation of their own ordinances. (c) They *(the City) do not treat all Beaver citizens the same. This is what I call discrimination. So Mayor and City Council, the things I would like you to do are these: (a) Clarify the city ordinance on city water use - both culinary water and the pressurized irrigation water. In doing this, be sure to include that "it's alright to use open furrow, and open discharge for gardens, lawns etc.,, as long as it is coming from a 3/4 inch opening on the citizen's ' side of the system.. ',!'*'" (b) I would like to see the city reimburse some of the good citizens of this community for the headache, labor and expense that has been caused. Thank you, EIRoyLStucki Greenwood Camp DUP Meeting The Daughters of Utah Pioneers Greenwood Camp' held their May meeting in the 1st-2nd Ward Church on Monday, May 11, • 2009. This was the last meeting to be held until September. Captain Pat Harris called the meeting to order with Ruth Littlefield offering the opening prayer and blessing on the food. The Pledge of Allegiance was recited, and the group joined in singing The Daughters of the • Grand Did Pioneers" led by Mildred Atkin, ace. by Carol Kesler. Janet Robinson presented the minutes of the previous meeting for approval. Glenna Harris was welcomed back into the membership upon returning from an LDS Mission in Nepal. Pat Harris introduced a tape written by a church historian named William Holzafel. It was concerning the "Women of Nauvoo", and it related to the circumstances surrounding the building of the Nauvoo Temple. Kirt Jones furnished a vocai solo. The lesson presented by Leola Myers was on "The Transcontinental and Utah Central Railroads. The golden spike was driven at Promontory Summit, Utah on May 10,1869. Th8 first transcontinental railroad was one of the greatest achievements of the American people in the nineteenth century. It made modem America possible. Brigham Young promoted the railroad. Utah pioneers graded the lines through Utah. When the last rail was-laid! The last spike driven! The Pacific Railroad was completed. Salt Lake City had a public celebration with similar celebrations throughout the Utah Territory. The enterprise was one of the most magnificent and important of its kind that had ever been accomplished by man on the earth. ( 1 1 1 Minutes Of The : Beaver City • Council The Beaver City Council met at 4:00 p.m. in a tegular • session at the Beaver City Hall •' on April 28? 2009. The following members of the Council were present: Mayor Leonard Foster, Council Members Connie Falls; Gordon Roberts, Chris Smith & Craig Wright Council Member Kari Draper was excused. Also, present were City Manager, Brent Blackner, & City Recorder, Anona Yardley. The Opening Ceremony of a thought, invocation, and Pledge of Allegiance was conducted by Council Member Smith. CITY COUNCIL MINUTES APPROVED: Minutes of the previous regular council meetIng of April 14, 2009 were read. Council Member Fails moved and Council Member Smith seconded the minutes be approved with typing and grammar corrections. DELL SMITH - CONGRESSMAN JASON CHAFFEJTS DEPUTY'..^RECTOR;1 Mr. Deil Smith and'Mr. W£de Garrett came to introduce themselves to the Council. They work with Congressman Chaffetz'ln his office, each focusing on different issues of concern. Mr. Smith and Mr. Garrett answered questions from Councii Members concerning state and local issues. TRACY DAVIS - LELAND SMITH PROPERTY: Mr. and Mrs. Tracy Davis met with the Council. Mr. Davis was acting as a representative for the Leland Smith Family Trust. He addressed the issues with irrigation on the Smith property. He reminded the Council of existing problems with the trusts North field 'property and failed annexation. . He feels the best deal for the family property would.be to annex into Beaver City. There is an existing utility right of way for the sewer line that goes on the North end of their property. The original annexation petition for this property was denied without notification to the family. Mr. Davis stated that the ditch by his property needs to be restored so the property owners on the lower part of the ditch can get the water. Discussion continued on possible locations of the ditch. Mr. Davis made his suggestions about where he thought the ditch should be in the best interests of the family Trust, Manager Blackner has visited the site recently. Possibilities of piping the water and a cement ditch were discussed. Ground settling was discussed as a problem with disturbed ground. Mayor Foster recommended that Manager Blackner work with Mr. Davis to do whatever is best for the him and the City. Discussion followed about other possible solutions to this problem. CL1SSOLO AND WIGNAL SUBDIVISION: Proposal from the Clissold and Wighal Annexation to make the 4 lot parcel a Subdivision came before the Council for approval. At present, there are 4 possible lots but only 2 homes. There were questions and discussion about the subdivision. Council Member Wright moved and Councii that t(ie Clisst re'accepted' subdivision upon the recommendation of the planning and zoning board. All voted in favor. The Council adjourned for a dinner break at 5:45 p.m. The meeting reconvened at 6:45 p.m. ADMINISTRATIVE AND COMMITTEE REPORfS: City Manager Brent Blackner: Rocky Mountain Mechanical from'Salt Lake City will be doing the maintenance assessment on the Library, Opera House, and Swimming Pool. ; " The Airport crack sealing Is done. It Wilt be allowed to cure for 30 days then the seal coat will be done. Two weeks later the re-striping will be done. Connie Davis is putting together sketches for the North Cemetery entrances. The pubtic have been notified about removing flowers from the cemetery before Mayv 1, in preparation for Memorial Day. Eagle's Landing project Is waitIng for UDOT recommendation. Mr Yardley is willing to extend the asphalt.to the end of his business. ' ' Manager Blackner spoke with BHS Principal, David Green, to discuss the matting on the concrete walls at the Tushar Mountain Complex. Beaver City and Beaver High will be going together to purchase this material: Beaver' City Clean Up will be the week of May 11th. Notices will be published in the paper. City residents need to be aware that each type of rubbish must be in a different pile. Discussion continued about different places the City would be responsible for. The block by the northeast school property and fence clean up was discussed. Beaver City will provide paint for some City signs. The Stop signs at the South Shell Station and Chevron are down. Parking at the Tushar Mountain Complex needs to be carefully monitored so people dont park In the wrong places. The Airport gate is still not working. It is still under warranty. The North Sewer 1800 North laterals are finished. Discussion continued about how to proceed with the project.
