Show I 1 fatal stabbing on friday J austrian miner minei used knife fellow countryman held answer on complaint char charging 9 murder in first degree A fatal cutting affray took place in eureka at about midnight friday john dosen being killed mike davich dosen was a man ot of but 19 ears and a stranger in eureka having arrived here from bingham but a day or two pre davich had been working at the chief cons mine he gives his age as 26 but la Is probably much old er circumstances surrounding the killing were not cleared up by the testimony which was given at the preliminary bearing hearing in judge crelghton creighton s court on tuesday but davich was held to the district court on a complaint which charged first degree murder and which was sworn to by mark borich a close friend of the dead austrian three witnesses were examined by the prosecution and about the same number testified for the defendant they told conflicting stories but as near as can be determined quite a number of austrians were spending the evening at the boarding house of mat Ro evich where the killing took blare pla the evidence does not show that davich had any trouble with dosen but when the members of the party who did not make their home at the house were leaving it Is alleged that davich struck do sen in the neck with a knife cutting the juggler vein dosen was evident ly carried back into the house and then when it was discovered that he ft as either dead or dying he vas was car ried out into the street where his body was picked up after the local officers had been called davich succeeded in evading ar rest until about 8 30 the following morning he ile made a trap to tintic gintic junction for the purpose of getting a train out of the district but was headed off by sheriff martin he ile they returned to eureka and tried to draw money which was coming to him from the chief cons mine the men at the mine office phoned to the officers and sheriff martin diceman savage and acting city mar hall responded davich in try ing to get away from the chief cons mine ran directly into officers sa vage and hall who made tho the arrest the officers also rounded up quite a number of austrians who were in the place at the time of the trouble these were locked up until the ar rival of county attorney bryan who checked up on the evidence and then allowed some of the men to go three of them the most important of the witnesses were put under bonds bond of each and it if they are unable to ghe bonds they will be kept in jail at nephi until the case comes to trial george A udall represented da vich in the preliminary hearing and will also defend the man when the case comes to trial in the district court davich has been removed to the state penitentiary at salt lake the sl BI ariff took him there yester lay funeral services for dosen were held from the catholic church in this city on monday burial took place at the city cemetery the dead man seems to have a large number of friends among the austrian residents of the camp and special officers were employed to guard the jail while his ills slaver was confined here sheriff martin de aided that the jail at nephi was hardly a suitable place in which to keep the man charged with dosen a murder I 1 |
