relating to to revenue and taxation be is resolved by the legislature of the state of 0 utah two thir 14 of all members elected to eacho of or the two houses conour concurring ring therein section 1 it Is proposed pio posed to amend article 13 of the constitution of the state of utah so that the same vt I 1 lead as follows I 1 the power of taxation shall never be surrendered suspended or contracted away all taxes shall be uniform upon the same class ot of pro perty within the territorial limits ol 01 authority levying the tax and shall be levied and collected for pub lie purposes only 2 the legislature shall provide provid by law for an annual tax sufficient with other sources of revenue to do fray the estimated ordinary expenses of the state or each fiscal year for the purpose of paying the state delt if any there be the leb lej slature shall provide tor for levying a tax annu annuala alli sufficient to pay the annual interest and principal of such debt athir twenty years years the fiscal pas ige of the law creating the debt 3 there shall be exempt from taxation property of the states of the state counties cities towns and school districts district ni pal corporations and public librae ies lots with the buildings thereon used exclusively for either i worship or charitable purposes and places of burial not held or used I 1 1 r private or corporate benefit ditches canals res pipes and flumes owned and used I 1 y n divi duals or corporations for airi gating lands owned by such ind vi duals or corporations or thefil di vidual members thereof shall not be separately taxed so long as they shall be owned and used tor for such purpose provided that mortgages upon real and personal J property shall be exempt from taxa tion and that the taxes from the in dicent poor may be i emitted or abated at such time an I 1 in such manner as provided by law 4 the legislature shall not im pose taxes for the purpose of any county city town or other pal corporation but may by law vest in the corporate authorities thereof respectively the power to assess and collect taxes for all pur poses of such corporation 5 the surface ground of all mines and mining claims both pla and rock in place containing or bearing gold silver copper lead iron or other valuable metals after purchase thereof from the united states shall be taxed at a value not giester gi eater than the price paid the unit ed states unless th eur sur face ground or some part thereof of ot such mine or claim is used for other than mining purposes and has a sep separate arite and independent value for such purposes in which case said surface ground or any part thereof so used tor for other than mining purposes shall be taxed at its value tor for such other purposes as provided by law and all machinery used in mining and all property and surface improvements upon or ap pur tenant to mines and mining claims which have a value separate and independent ot of such ouch mines oi 01 mining claims shall be taxed as pro vided by law all lands containing coal granite stone marble onyx a gas oil adro carbons gypsum or other valuable mineral deposits oth er than those enumerated above in to exceed three mills on each dollar of valuation tor lor district school pui put i poses not to exceed one half mill on each dollar for valuation for high school purposes that part of the state tax apportioned to high school purposes shall constitute a lund to be called the high school fa fund id and shall be apportioned to the cities and school districts maintaining high schools in the manner the leg isla tuie tute may provide aid when ever the taxable pro property lerty within the state shall amount to I 1 our hundred million dollars the rate shall not exceed five mills on each dollar of valuation unless a proposition to increase such rate specifying the rate proposed and the time during which the same shill be levied be first submitted to a vote of such of the qualified electors of tle state as in the year next prece proceeding eding such election shall have paid a property tax assessed to them within the state and the majority of those vot ing tl ti ereon shall vote in favor there of in such manner as may be provid ed by law 8 the making of profit out of public moneys using the same sanie tor for any purpose not authorized by law by any public officer shall be deem ed a felony and shall be punished aa as provided by law but part of such punishment shall be disqualification to hold public office 9 no appropriation shall be made or any expenditure authorized by the legislature the ex tures of the state duding adiv fiscal year shall exceed the total tax then provided for by law and applice able tor for such appropriation or eapen deture unless the legislature making such appropriation shall provide for levying a sufficient tax not exceed ing the rate allowed in section 6 of this article to pay such tion or expenditure within such fis cal year this provision shall not apply to appropriations or expends tures to sur press insurrections da del fend the state or assist in defend ing the united states in time oi ot war 10 nothing in this constitution shall be construed to prevent the legislature from providing a stamp tax or dr a tax based on oil income mccu pation license or franchises section 2 the secretary of state is hereby ordered to give this apropo to be published pub shed in at least one nevis newspaper paper in every county in the state where a newspaper is printed and published tor for two months pre ceding the next general election section 3 thia this proposition shall be submitted to the electors of 0 this at next general their approval or disapproval all official ballots used at such election shall have printed or written thereon the words for the amendment of article 13 of the constitution re lating to taxation yes no and shall otherwise be prepared and sub fitted to the electors as may other wise be provided by law and said ballot shall be received counted and canvassed car assed and returns thereon be made in the same manner and in all respects as in ili or may be provided by law in the case dase of election of state officers section 4 it adopted by the elec tors of the state this amendment shall take effect january 1 1917 approved Appi oved march 1915 |
