taxation be Is resolved by the legislature of the state of utah two thir li of all members elected to each of the two houses concurring therein section 1 it Is proposed to amend article 13 of the constitution of ti tl e state so that the same w I 1 read as follows I 1 the power of taxation shall neer neier be surrendered suspended or contracted away all taxes shall be uniform upon the same class of pro perty within the territorial limits 01 01 the authority levying the tax an 1 shall be levied ikid collected for pub lie lic purposes only 2 the legislature shall provide by law for an annual tax sufficient with other sources of revenue to do fra the estimated ordinary expenses of the state or each fiscal year for the purpose of paying the state dett delt it if any there be the leg slature shall provide for levying a tax annu annuals alIN sufficient to pay the annual interest and principal of such debt within twenty years from the fiscal passage of the law creating the debt 3 there shall be exempt from taxation property of the jmel states of the state counties cities towns and school districts munica pal corporations and les lots with the buildings thereon used exclusively for either religion religious worship or charitable purposes and P places laces ot of burial not held or used 1 r private or corporate benefit ditches canals res pipes and flumes owned and used by n divi duals or corporations for lin tiri gating lands owned by such ind vi duals or corporations or the idi it di vidual members thereof hall not be separately taxed so long as they shall be owned and used excy nely tor for such purpose provided that mortgages upon real and u property shall be exempt from teia tion and that the taxes the in dicent poor may be remitted remit tec or abated at such time and in such manner as provided by law 4 the legislature shall not im pose taxes tor for the purpose of any county city town or other pal corporation but may by law vest in the corporate authorities thereof respectively the power to assess and collect taxes for all pur poses of such corporation 5 the surface ground ot of all mines and mining claims b both oth P pla la and rock in place containing or bearing gold silver copper lead iron or other valuable metals after purchase pui chase thereof from the united states shall be taxed at a value not riot greater than the price paid the unit ed states unless th hur bur face ground or some part thereof of such mine or claim is used tor for other than mining purposes and has a separate and independent value tor for such other purposes in which case said surface ground or any part thereof so used for other than 0 mining purposes shall be taxed at its value tor for such other purposes as provided by la law and all machinery I 1 used in mining and all property and surface improvements upon or ap pur tenant to mines and mining claims which have a value separate and independent of such mines or mohing claims shall be taxed as pro vided by law all lands containing coal granite stone marble gas oil hydro hydrocarbons carbons gypsum or other valuable mineral deposits oth er than those enumerated above in this section after purchase thereof from the united states and all pro perty and surface improvements up on or app ir tenant to such landt which have a value separate and in dependent of all such lands shall be taxed as provided by law in addition to the assessment of the surface grounds improvements ti a 0 machinery of mines and mining claims all mines and mining claims producing net proceeds shall be tai ta ed at a value not to exceed three times such net proceeds 6 an accurate statement of the receipts and expenditures of the pub lie moneys shall be published an dually in s ich manner as the legis lature may provide 7 the rate of taxation on pro perty for state purposes shall never exceed eight mills on each dollar of valuation to be apportioned as fol lows not to exceed tour four and one half mills on each dollar of kalua tion for or general state purposes not t to exceed three mills on each dollar of valuation for district school pur poses not to exceed one half mill on each dollar for valuation tor for high school purposes that part of the bbate tax apportioned to SQ high school purposes shall constitute a fund to be called the high school fund and shall be apportion apportioned eld to ta the cities and school distri districts 48 maintaining high schools in the manner the leg may provide and when ever tle tt e taxable property within the state shall amount to atour hundred million dollars the rate shall not exceed five mills on each dollar of valuation unless a proposition to increase such rate specifying the rate proposed and the time during which the same shill be levied be arst submitted to a vote of 0 such of 0 the qualified electors of the state as in the year next prece proceeding eding such election shall hae haie paid a property tax assessed to them within the state and the majority of those vot ing tl ereon shall vote in favor there ol 01 la in such manner as may be provid ed by law S 8 the making of profit out of public moneys using the same for any purpose not authorized by law 1 by any public officer shall be deem ed a felony and shall be punished as provided by law but part ot of such punishment shall be disqualification to hold public office 9 no hp appropriation shall be made or any expenditure authorized by the Legi legislature lature whereby the ex of the state during any fecal year shall exceed the total tax then provided tor for by law and applice able tor for such appropriation or ex eapen deture unless the legislature making such appropriation shall provide for levying a sufficient tax not exceed ing the rate allowed in section 6 of I 1 this article to pay such tion or expenditure within such fis cal scar ear this provi provision bion shall not I 1 appi apply to appropriations or expend tures to suppress sut press insurrections de fend the state or assist in defend ing the united states in time ot war 10 nothing in this constitution shall be construed to prevent the legislature from providing a stamp tax or a tax based on income mccu pation license or franchises section 2 the secretary of state Is hereby ordered to give this apropo to be published in at least one newspaper in every county in the state where a newspaper Is printed and published for two months pre ceding the next general election section 3 this proposition shall be submitted to the electors of this I 1 state at the next general election for their approval or disapproval all ishall official ballots used at such election shall have printed or written there ion on the words for the amendment lof of article 13 ot of the constitution re lating to taxation yes no and ishall shall otherwise be prepared and sub bitted to fo the electors as a may other wise be provided by law and said ballot shall be received counted and far ar cassed and returns thereon be made in the same manner and in all respects as in or may be provided by law in the case of election of state officers section 4 it if adopted by the elec elac tors ot of the state this amendment shall take effect january 1 1917 approved march 1915 |
