Stephen M. Jones, proprietor of the Cosmic Aeroplane when it was in business last July at 875 E. 9th South, had appealod a city court conviction of the charge, a misdemeanor under city statutes, to district court. Judge D. Frank Wilkins took the case under advisement after hearing early this month. He asked for briefs from Floyd Gowans, assistant city attorney who prosecuted the original complaint after city police confiscated the materials last July, and from Galen Ross, Jones' attorney. Gowan's brief cited the now historic case of Ginsburg vs. the United States. This case resulted in a ruling of the U.S. Supreme Court which states if allegedly obscene materials have "no purpose or value other than to appeal to prurient sexual interests they are in fact obscene." Gewans also said the court ruled against Ginsburg because his publications were "an affront to contemporary society."
