Show warrants issued for stealing ore from cars on wednesday of this week mar henroid arrested john peart aged 23 and robert calvert aged 17 both being chaigen with stealing ore the ore in question is supposed to have been stolen from the railroad cais cars after they had been loaded tor for shipment to the valley smelters the bulk of the ore no doubt being re moved from cars belonging to the chief cons mining company the cais cars of this company are loaded at the mine and switched to a point just west of the rio grande depot where they are allowed to remain until the following morning when they aro are taken out by the freight crew on the bait salt lake route the point at which the cars are left at night is but a short distance from the peart rest dence and it would have been an easy matter tor for peart to have car ried away a few sacks of ore almost any night marshal henriod first t discovered that peart had ore jan his posses slon sion and he later s succeeded in learn I 1 ing t thadore ore had been e sold old to G A F franke an k nd rid taker to the latter s war warehouse eliou e on or upper main street an e C on of ke warehouse result ed in tha th cocat location 0 cat on of about 12 tons of ore an ana mr franke promptly in formed th the h 0 0 officer icer 1 that he had pur chased the theoris or 0 r in small lots some of it being sold sol 01 a 0 him by peart A few sa a s of the same kind of ore was stored in ln a small building near the peart residence A charge of grand larceny has been lodged against peart and calvert who have been released on bond pending the arrival of the county attorney the ore in question is said to be ed at about 1000 mr franke states that at various times during the past few years be he has purchased ore in small lots he ile got halt half a ton from ralph badger another small lot from wolf marks another bunch from the car repairer at the rio grande depot and several sacks from john peart as well as con sign ments of ore from other parties he ile purchased the first lot of ore from peart in january of this year paying him at the rate of 1 00 per pounds mr franke states that peart assured him that he had picked the ore up along the railroad tracks and that a part of it had been taken from a lease which he operated for a short time the last lot of ore which be le purchased from peart was turned over but a day or two previous to the arrest made by marshal hen rio I 1 mr franke says he believed the story told him by peart and had no idea that the ore had been stolen framl citler eitl er from the local mines or from cars which were ere in transit to the smelters he ile says be he is only to anxious to co operate with tl e of fibers in securing a al conviction it if a crime has been committed I 1 officials of the chief cons mine have employed attorney y N A rib ertson to assist in the prosecution ot of ithe the case being determined to put a s stop top to ore stealing and other mines have expressed a willingness to co operate attorney B N C stott of salt lake has been retained to defend peart and calvert |
