Show 4 page 8 newsprint deoember 9, 1981 Planning A Zoning Amendment Public Hearing. planner Bob Nicholson and Jack Seitz advised the Council that the Planning Commission was recommending that the Planning A Zoning Oridance be amended to eliminate attached dwellings in RA-- I and R- -l zones. After some discussion, Jack Seitz made the motion to adopt an ordinance prohibiting this type of dwelling in R- -l and RA-- 1 zones. Karl Migliori seconded the motion, motion carried unsnimously. Public Works Construction Specifications Ordinance Amendments. City Manager Bassett and Public Works Director KAy Overson discussed the amendments to the construction specifications with the Council, and after a brief discussion, the Council requested this be brought back to the next meeting with clarifications as indicated by the Council. Council of Governments Agreement. City Manager Bassett outlined the amendments to paragraphs H and 1. After some discussion of the changes, the Council requested the agreement be distributed to the County for further distribution to Ballard and the Ute Indian Tribe for their input. PWD Overson reviewed the Uniform Building Code Ordinance Amendment. proposed changes in the UBC code for engineering review costs. After some discussion. Jack Seitz made the motion to adopt Ordinance No. amending the UBC Code. Gene Anfinson seconded the motion, motion carried unanimously. Jack Seilzat this time reminded the Council that the permit for the temporary trailer for basin State Bank would expire very shortly. Management Reports - City Manager. Manager Bassett reported on the following: ) New Sewer Impact Fee Schedule, manager Bassett reminded the Council that the new impact fees for sewer connections are supposed to go into effect Jan. 1, 1982; however, in some of the new annexation areas, the City staff has been telling the residents to put off purchasing their water connections until a court decision has been reached relative to who will provide sewer service. This will create problems for the charging of the new sewer fees to those residents. Karl Migliori suggested that the City go ahead and collect those sewer fees and place the funds into a special account. Then when the court decision is reached. those funds will either be turned over to AVWSD or to the City. There was some discussion as to informing those residents of the possibility of having to pay a higher rate if the court rules in favor of the District. The Council then discussed the problem wit h the contractor at the sewer lagoon and the delays this is causing in the operation of the lagoons. After considerable discussion, the Council requested letters be sent to EPA. and to both the Federal and State Legislators and also to Governor Mathcson. The Council further requested that an amendment be prepared, postponing the initiation of the new sewer fee schedule until the problems with the sewer lagoons is Vernal City Council (twin-home- minutes December 2, 1981 Unofficial Regular meeting of the Vernal City Council held December 2. 198l.cal)rd to order at 6:33 pm. Mayor Snyder called the meeting to order to dicuss the agreement between Vernal City and Deseret Generation and Transmission for impact mitigation funds. Mayor Snder asked Mr. Ken Fisher, representing Deseret GAT. how the City and IXiAT can know that the impact of 'this development is what it will be in the future. This was discussed at length. The draft agreement was then reviewed at length, and the City Attorney. Dave Burningham was directed to meet with DGAT's attorney. Elgin Ward, to incorporate the discussed amendments into the agreement. Mayor Snyder called a five minute recess at 7:25. At 7:30. the meeting was called to order. Minutes. After a brief preview of the previous minutes. Jack Seitz made the motion to approve those minutes as read. Gene Anfinson seconded the motion, motion carried HJO Annexation Ordinance. City Manager Hassell reviewed with the Council the proposed annexation of approximately 3.7 acres of land located on 300 East at approximately 1000 South. There was a discussion of the problems with sewer service from the City to this area and this will be further discussed in future meetings. Karl Migliori made the motion to adopt Ordinance No. 9 annexing adjoining lands and Jack Seitz seconded the motion, motion carried prescribing a zone designation of unanimo ualy. Water Master Plan. City Manager Bassett advised the Council that the City is still in possession of a DOE grant for a water master plan, however the Council had previously requested this be postponed until the water seperation occurs. However, the grant is supposed to be expended before the end of December, but we are in the process pf attempting for an extension of time. There wasa brief discussion of which areas to include in the master plan, and Mr. Wayne Swett. representing the Ashley Water Co., then presented a letter to the Council signed by the Directors of this water company, requesting the City's support for this whole area to annex to the City. After a brief discussion, both Karl Migliori and Jack Seitz did state they would support such an annexation. After further favorable discussion. Mayor Snyder advised Mr. Swett that the consensus of the Council was favorable to the annexation. Sales Tax Redistribution. City Manager Bassett and Mayor Snyder reported to the on Council on the sales tax redistribution meeting they attended in South Salt Tuesday, December 2. Manager Bassett outlined the proposed redistribution, and altera considerable discussion, the Council requested that special meetings he set up with our State Legislators. Water availability for Steinaker Development - Cal Sorenson addressed the Council relative to a commitment made by previous Councils for water to a development on the north side of the Steinaker Reservoir. Mr. Sorenson asked that the Council again verify that when water is available, he will be able to be served with culinary water service for his proposed development. Mr. Sorenson slated that until water is available, in the next two to three years, he would not be able to develop his property. After some discussion of the location of the proposed development. Greg Hawkins made the motion to authorize the City Attorney to draft an agreement relative to the availability of water to this area.
