Show &?!& ' LETTERS continued from page 2 Man has facts wrong in property tax dispute Dear Editor, I am writing in response to the letter of Roger Holfelti, which waa printed July 3. After reading hia letter, I reread your article printed June 26 to Bee if I had mined some thing. I had not. The facts in your articles accurate. Facts stated in Mr. Holfeltxs letter were not When Mr. Holfelti spoke with the Duchesne County Treasurer, Colene Nelson, he only offered to pay hia delinquent property taxes fin' the 1997 tax year. Mrs Nelson informed him that by state law she could take his money but could only apply it to last years delinquent taxes not those for 1997. Mr. Holfelti did not make his payment He now says that he cannot find suchalaw. He is wrong. It is found in the Utah Code at Section entitled Redemption and requires the county treasurer to ap- - year in the delinquent count and continue applying the partial payment in the same manner. Mr. Holfelti s partial payment, by state law, had to be first applied to the taxes owed for the tax year 2000. Mrs. Nelson was right in what die told Mr. Holfelti: As Mr. Holfelti is wrong on his bets, he is also wrong on his legal conclusions. Mr. Holfelti claims that . state law now frees him of his tax obligation because he made an offer to pey that was refused. Hr cites Utah Mr. Code Section Holfelti misstates the facts. That section applies to commercial transactions not tax redemption and furthermore he only states part of the section. Where Mr. Holfelti ends the section with a period, the original section hasacomma and continues to state that the section applies only as between endorsers and third parties. This section does not apply as between debtor and creditor. Again Mr. ; advantage ofthe opporuntitiee of education and vocational training laid before you to make yourself useful! By itself this sounds reasonable enough, but if you dont have the right to free foud and housing at ( Article II), and you dont have the right to free health care (Article 1), and you dont have the right to a job so that you can pay for these things, what choices are left besides stealing or starving? From another point of view, isn't it a bit contradiction to claim that adults have duty to provide for themselves and their families, but then they claim that they dont have the right to a job or the means to do so? Its more-or-leaccepted that children have the right to education at public expense, but is this education doesnt give someone the skills to work once they got out of school. Its miseducation and a waste of public fluids. Lets not just point fingers at the turn liberals if we let into every one for himself. Holfelti ia wrong. Mr. Holfelti is also wrong in his tegal conclusion! for not paying his property taxes in the firal place. Hie legal theory rests on the fact that a land patent is a grant from the ernment of alloidal title free ofobli- gations to the government Therefore ifhehasalandpatentin his name he has no obligation to pay taxes. While it is true that a land patent is a title grant from the government, the issuance of a land patent by a landowner to himself, as Mr. Holfeite did, ia not valid. Two courts have held such documents to be selfserving documents of no value. Furthermore, the theory rests on an old English legal doctrine of Alloidal title, which is a grant of title to lands by the King to a feudal lord which is me of the feudal re- sponaibilities of providing money, recog-nizingevi- l, face. As a grown-u- p I like to pretend evil doesnt exist. But on the evening of July 6 when Roosevelt City Police ChiefCecil Gurr was gunned down, I remembered the monsters. I recognised evil's sinister face - and at the same time grieved the loss of its noble combatant of 26 years. For if there was one thing Chief Gurr was about it was protecting the commu nity from its foul presence. My husband sees stark reality much better than I. Mr. Holfelti ignores the feet that this doctrine has not been in effect in England for hundreds of years, and never came across the water to become part of American law. It is unfortunate that Mr. Holfelti lost his house, but he was offered all legal means to avoid that consequence. Mr. Holfelti rested hisclaim ofnot having to pay his property taxes on a legal theoty that has been dead for hundred ofyears and is not applicable to American and Constitutional law. Mr. Holfelti could not be saved from himself, but hopefully this letter will save others from the same fete. time.
