Recent court decision upholds referendum on local taxes Utah taxpayers have the constitutional right to refer new taxes to a vote ofthe people through initiative or referendum, according to a recent court decision. "This is a great day for taxpayers throughout the state of Utah," declared Howard Stephenson, President of the Utah Taxpayers Association. "We were convinced that the Utah Constitution guarantees the right of the people to override the legislative decisions of their elected officials. We are thrilled that the court agrees with us." he said. "The 1987 law has insulated local officials from the will of the people," Stephenson claimed. "Because Utah has no recall law, citizens are unable to remove unresponsive public servants from office until the next election, which may be as many as four years away. This reinstatement of the citizens right to veto the legislative acts of local officials ensures that these officials are more responsive to the will of the people." In the case Bigler v. Vernon, judge Ray M. Harding of the Fourth District Court determined that taxpayers should have been allowed to refer a new six percent utility franchise tax to the voters. The suit was brought by members of the Utah Taxpayers Association who filed petitions with the city. Payson city officials refused to grant the petitions based on a 1987 law, Senate Bill 9, which Payson city claimed prevented citizens from invoking the right of initiative and referendum concerning tax and budget issues at the local level. The Taxpayers Association has also brought suit against Sevier County which increased property taxes SO percent in each of the last two years. Petitions were circulated and signed by a sufficient number of voters to require a referendum vote, but county officials cited the 1987 law, claiming they were not required to allow a vote on property tax increases. The trial in the Sevier County case will be Wednesday, November 13 in Richfield. The Payson City case which was just decided in favor of taxpayers dealt with the issue of a new tax. The Sevier County suit deals with an increase in property taxes. While the right ofreferendum on new taxes was upheld by the court, the court also ruled that the plain- - No, blood drives are not part of the State Core Curriculum. Tickets are available on a standby basis only, but those who are interested are encouraged to come thnt morning. Adding to the uncertainty, studies so far have not shown how electric and magnetic fields could interact with cells to affect health. Electric and magnetic fields are present when electricity moves through a wire. The fields surround utility power lines, home wiring, water pipes which return currents to the ground, kitchen appliances, TVs, computers, electric blankets, and heater wires in floors and ceilings. The strength of the fields depends on the current in the wire, and distance from the wire. that exposure to higher1 levels' is actually less hazardous than lower levels. Government and electric utilities around the world are currently spending $15 million a year to research the health effects of EMF. The National Rural Electric Cooperative Association, which represents the nations 1,000 consumer-owneelectric utilities, has supported legislation in Congress to increase the level ofresearch into the health d effects of EMF.
