Show UINTAH BASIN STANDARD. 9 of October where DUCHESNE NEWS Orinda Gee Kipp and Helen Merkley went to Coalville on September 18 for Helen's Birthday, the Primary put on the program that Sunday, Kipp and Helen had five grandchildren that were in the program, which they loved very much. e Bella and Walter Lefevre of Tabiona, had as quests last week, her sister Leona and Clyde Hancock of Salt Lake they all came to our Senior Dinner on Thursday. The Vern Bromley's, Hsrold Gee's and Dave Thomas' all spent three days camping up . at . Red Creek last week. e We would like to thank all of our many friends that came from Roosevelt, Altamont and Duchesne on Friday, October 2 to attend the funeral of Raye Baart one of our special Senior Citizen's. We thank . Don Mayhew for loaning his musical instrument that was played so beautiful, for Dave Baum that helped take care of the tables and chairs, also thanks to everyone that donated in leu of flowers, so we had a good sum of money with a beautiful card to the family of Raye, at a time like this. Thsnks to the many friends that came from her church, Raye will always be remembered as the lady that wore all those cute hats, e Eldon Wilcken has been home again for a few day's he reports that he is feeling pretty good, we are very glad, was glad to have him out to our dinner on Thursday of last week. e The Senior Citizen's Bus left on Wednesday to be gone the 7, 8, and Obituaries they will be spending their last holidays at Wendover, Utah. e Verda and Marvel Moore are both on the' improve after they, have both been on the sick list. As we understand Mable McMor-ri- s is still quite ill yet, and is still in the rest home in Roosevelt. e Christen Nation and her sister-in-laPhebe Giles of Ogden left on Monday of last week to go to Hyde Park in Logan to attend a wedding and reception. e Vickie and Richard Fitsgarld parents of Vickie, Grand mother's Ora Ellingford of Roosevelt, Christen Nation, and Aunt Phebe Giles, all went to Provo on September 28 to take Vickie into the MTC she will be learning Spanish as she ia going to fill a LDA Mission in Santigo Dominican Republic, e Carol and LaMar Thomas and their family of Orem was out and spent a night with her mother Zells Grant, they came to attend the funeral services for a grandson of Norma and Niels Earl, son of Wendy and Grant Earl of Roosevelt, he was the great grandson of Lorraine Broadhead Roosevelt and Zells Grant in Duchesne, e Marvel and Verda Moore are very much on the improve since they have both been on the sick list, we do wish them both well e Ada and Sharkey Thomas had Adas two sister-in-law-s spending Tuesday night with them Marva Rasmussen of Pueblo, Colorado also Robin Rasmussen of Salt Lake, e David and Alica Evans had a baby boy born at the Duchesne County Hospital on Saturday September 26. Grandparents are Ada and Clark Lusty, he was named Randell Jay Evans, e JulAnn Dart daughter of Marie Hatch that has been spending some time with her mother, has left and gone to Evanston, Wyoming, where she will be spending some time with her daughter and three children. Donal Lloyd Kolb age 76 of Lake Isabella, California died peacefully at home on September 80, 1987. He was born April 23, 1911 in the Fort Duchesne Area to Donal I and Ethel Daniels Kolb. He married Ethel Cochran in 1931, they were later divorced. He worked on heavy equipment and was handy at anything he did. In his retiring years he was very active in several hobbies and very creative with his hands. He has lived in California the last 45 years. He is survived by his mother Ethel D. Kolb of Roosevelt, sons and daughters, Larry L. Kolb of Lake Isabella, California, John Wayne Kolb of Lancaster, California, Cosma Lee Childs of Oxnard, Merlin California, one step-so- n Pinnell. His brothers and sisters are Ty Kolb, Jewell D. Kolb, Quentin F. Kolb all of Salt Lake City, Utah. Naturitch Stevenson and La Donna Johnson of RooseHe haa several velt, Utah. Shumway Calvert Arzella Shumway Calvert, age 70. of Myton died October 1987 at her' home. She was born June 16, 1917 in Blanding, Utah to Joseph Sixtus and Alice Oliver Shumway. Married Jack M. Calvert November 80, 1935 in Monticello, Utah. She liked to fish and hunt with grandchildren and one great grandchild. He was preceded in death by his father Donal I. Kolb, two brothers, Manfred and Devon Kolb and an infant daughter Elizabeth Ethel. Private services were held at his daughter's in Oxnard, California on October 5, 1987. Additional Beaver Permit: Enrolled members of the Tribe and Mixed Bloods may be issued mare than one beaver trapping permit per season, provided, that prior to acquisition of an additional permit, the requesting member can demonstrate that 50 beaver have been taken under the prioriy issued permit. 2. Trapping Bobcat: Enrolled members of the Tribe and Mixed Bloods may, under permit, trap bobcat provided, however, that prior to sale of bobcat pells, such pelts belonging (a) A non-e- n rolled tribal member may not have in his possession any firearm other than a pistol of .22 caliber rim fire. quad-runnerand 3. (b) The use of airboats, aircraft, three-wheelersnowmobiles by trappers is prohibited. D. PENALTIES Any Tribal member or Mixed Blood violating any of the rules and regulations set by this Wildlife Advisory Board and approved by Ihe Business Committee and Ute Distribution Corporation will be subject to prosecution which may result in a fine and loss of hisher hunting privileges. Tribe Indians: Any Tribal members, or Indian of members and non-Lit- e tribe, violating any of the rules and regulations set forth herein are subject to prosecution to consist of imposition of a $200.00 fine andor imprisonment for a period not exceeding 90 days for each violation and loss of all trapping paraphernalia and peltries confiscated at the time of arrest. In addition violations may result in losing hitAier privileges far a period of two years, after due notice and hearing before Tribal Court. ' 2. Mixed Bloods, terminated members of the Ute Indian Tribe: Any authorized Tribal Fish and Wildlife Officers wilh reasonable cause to believe that a Mixed Blood ha violated any rule or regulations set forth in this Proclamation or contained in Title VII of Ihe Ute Law and Order Code, shall place such Mixed Blood in tha custody of the proper federal agency for enforcement and prosecution under applicable federal 1 . Tribal another laws. E. Civil Action 1 . Nothing in this Proclamation shall preclude ihe Tribe from paying for and being awarded punitive and compensatory damages in addition to imposition of a sentence in any action filed for a violation of this Proclamation or under separate suit wherein it is alleged that tha perpetrator performed the act wantonly, or maliciously. 2. The Court, in guessing punitive and compensatory damages, shall determine tha amount in the soma manner in which it would determine punitive and compensatory damages in any civil action. F. Enforcement 1 . All Tribal Police Officers, Conservation Officers, and Federal Law Enforcement Officers are herewith bestowed the authority to enforce tha provisions of this Proclamation, and shall be referred to hereafter as "Authorized Officers". 2. Any authorized officer may in carrying out the intent and purpose of this Pro- clamation: (a) Execute bench warrants issued for the detention of persons or intities acting in contravention of this Proclamation. (b) Serve subpoenas or other legal documents issued in matters arising under this Proclamation. (c) Seize any paraphernalia used in a violation of this Proclamation as evidence for payment of any fines or damage payments imposed pursuant hereto. G. Enforcement Procedures 1 . If an authorized officer determines that a particular person has acted in contravention of this Proclamation, such officer shall issue to tha damaging or violating party a "Notice to Appear", to answer for the acts alleged. 2. Suspected violators or damage contributors shall sign tha "Notice to Appear" and, if not arrested for expulsion, trial, or federal prosecution, shall b escorted from tha place of infraction and released. In the event a person, the subject of service of a "Notice to Appear", shall refuse to sign the same, the serving officer lhall make note of tha attempted service, tha time and location thereof, and refusal of the served person to accept service, where upon effective personal service shall be presumed. H. Other Sanctions 1. Contempt: All persons party to actions brought under this Proclamation, shall be subject to the civil contempt power of whether members or the Tribal Court, and may be sanctioned by any means provided for by tha Ute Low and Older Coda for civil contempt, including, but not limited to, imprisonment to compel compliance with a lawful court order. of tha Tribe triggers 2. Expulsion: Nothing in this Proclamation shall be deemed to preclude tha use of for violation of this Proclamation under tha tha remedy of expulsion of Ufa Law and Order Code, and any authorized officer may follow tha procedures provided by tha Tribal Law and Order Code lo initiate any action for expulsion in addition to or in lieu of any other enforcement procedure provided for by this Proclamation. 4. Levy Against Property: In Ihe event o person or entity violating this Proclamation shall foil to comply with an issued "Notice of Appearance", fail to remit any and all compensatory andor punitive damages imposed hereunder, fail to depart the reservation upon a finding of expulsion, commit a trespass, fail to comply wilh on order of the Tribal Court for civil contempt, or have been found guilty of an offense hereunder, nothing herein shall preclude the Tribal Court from attaching such person's confiscated or on reservation property in lieu of sums owed tha Tribe or to assure the offending parties compliance with Reclamation or Orders of Ihe Tribal and security Court. 5. s of the Indian Tribe): (including Mixed Bloods, including Mixed Bloods who are not also enrolled in a federally recognized tribe, who violate any of tha rules and regulations above set forth, or who are apprehended hunting without a permit validly issued in accordance with this Proclamation are subject to tha following Federal Statutes: 18 U.S.C. S1 164: DESTROYING BOUNDARY AND WARNING SIGNS "Whoever willfully destroys, defaces, or removes any sign erected by on Indian Tribe or a government agency to (1) indicate the boundary of an Indian reservation or of any Indian country os defined in Section 151 of this title; or (2) give notice that hunting, Irapping, or fishing is not permitted thereon without lawful authority or permission, shall be fined not more than $250 or imprisoned not more than six months or 1 both." (a) Trapping Season: October 1, 1967 to April 30, 1918 19B7 to January 31, 1988 . (b) Bobcat Season: November 28, BOBCAT TRAPPING CLOSED TO 3. It shall be unlawful to use any form of wildlife protected by tribal or federal law, or any parts thereof, as bait or scent except parts of legally taken in trapping any wildlife on the reservation. No trap or other trapping devices may be set within 30 feet of any form of exposed bait. 1 1 . Only those Individuals receiving a valid tribal permit are permitted to trap No potion shall lend, transfer, sell, give or assign hisher permit or tag to ped 18 U.S.C. SI 165: HUNTING. TRAPPING. OR FISHING ON INDIAN LAND "Whoever, without lawful authority or permission, willfully and knowingly goes upon any land that belongs to any Indian or Indian Tribe, band, or group and either are held by the United States in trust or are subject to a restriction against alienation imposed by Ihe United States, or upon any lands of the United States that at reserved for Indian use, for the purpose of hunting, trapping, or fishing thareon, or for the removal of game, peltries, or fish therefrom, shall be fined not more than $200 or imin his prisoned not more than ninety days, or both, and all game, fish and peltries possession shall be forfeited." 16 U.S.C. 3371, et. seq: Pursuant to 16 U.S.C. 3372, any person importing, exporin ting, transporting, selling, receiving, acquiring, purchasing, or possessing game violation of this Proclamation may be subject to a civil penalty of $10,000 for each violation or criminal prosecution seeking a fin of $20,000 andor imprisonment for not more than five years.
