BE IT FURTHER RESOLVED that we hereby request that Superintendent of the Uintah and Ouray Agency pursuant to Section 162.S, Code of Federal Regulations, and authority delegated to the Superintendent of the Uintah and Ouray Agency by the Phoenix Area Office under Redelegation Order No. 3, doted July 1, 1959, to support the Tribe in management and protection of Ht range, forest land, livestock and game resources by closing Bureau of Indian Affairs occassional maintenance routes listed below to all unauthorized personnel during this same period of time-- . H being further understood that oil companies and other authorized organizations will furnish Ihe Chief of Police and Resources Division of the Ute Tribe a listing of their authorized personnel who will be utilizing these roads: a. Utah, Slip. Op. of May 20, 1982) held that those persons terminated from the Ute Indian Tribe of Ihe Uintah and Ouray Reservation, Utah, pursuant to Ihe Act of August 27, 1954, 68 Slot. 868, retainshare of Ihe huned a pro-ratting and fishing privileges of Ihe Tribe equal to 27.16186 of the takeabie wildlife of the Reservation, and WHEREAS, subsequent to such decision Ihe Ute Indian Tribe Fish and Wildlife Advisory Board, by Resolution of August 9, 1962, No. a 82-0- 5 recommended rules and regulations for Ihe taking and hunting of Antelope, Elk and Deer by boih members and of Ihe Ute Indian Tribe, including Ihe hunting of said animals by terminated members of the Tribe, hereinafter Affiliated Utes, and WHEREAS, those recommended rules and regulations governing Ihe distribution of Deer and Antelope permits represent a fair division of available game between members of the Tribe and Affiliated Utes in conformity with United States v. Feller, supra., and WHEREAS, said permit division did not, however, take into account lhat Ihe management costs atributable to Ihe asserted Affiliated Ute share of wildlife totals same (60,590.00 dial sum arrived at by dividing the Tribal Fish and Elk, Wildlife budget minus (281,920.00, wildlife (58,849.70, and of offset of income by 27.16186, WHEREAS, if Affiliated Utes do in fact possess a right to take a 27.16186 portion of Reservation wildlife, it is Ihe responsibility of lhat entity composed of their number to bear their proportionate share of management costs and not the responsibility of the Ute Indian Tribe and its member- ship, and those animals WHEREAS, identified for hunting hereinafter are managed by the Tribe, located within Ihe jurisdiction of Ihe Tribe, and have been managed under Ihe tribal fish and wildlife budget, and with the major WHEREAS, exception of cost to be imposed, the Business Committee of Ihe Ute Indian Tribe is of Ihe opinion that those rules and embodied regulations in Resolution No. should be adoated: NOW, THEREFORE, BE IT 82-0- 5 RESOLVED BY THE UINTAH AND OURAY TRIBAL BUSINESS COMMITTEE OF THE UTE IN- Ihe following rules and regulations are hereby placed in full force and effect on Ihe Uintah and Ouray Reservation provided, however, that all permits herein set forth for drawing or other acquisition by Affiliated Utes shall not be bestowed upon Ihe winners thereof unless and until said Affiliated Utes remit to Ihe Tribe Ihe sum of (60,590.00 as payment for management cost incurred in Ihe upkeep of purportally Affiliated Ute owned wildlife existing on Ihe Reservation: A.
