Show 7 Sun Advocate Price, Utah Tuesday Utah Legislature adopts state privacy guideline restricting public access to motor vehicle title, registration files Effective May 1, the Utah motor vehicle title and registration file will be reclassified as a protected record. The motor vehicle title and registration file is currently consider public access information. However, the department of motor vehicle information will have the same access restrictions as the agencys tax files, except for certain statutorily permitted uses starting May 1. The news media will no longer have access to the file. The change is the result of the passage of Senate Bill 174 by the Utah Legislature. Sponsor Sen. Karen Halt Introduced the bill to bring Utah into compliance with the newly amended federal Drivers Privacy Protection Act, Under the current state law, Utah motor vehicle files are pub- -' lie records, but vehicle owners may opt to have the related information protected from disclosure or sale for marketing purposes. However, Utah officials deter mined that the existing option does not pass the muster of the federal Drivers Privacy Protection Act, which was amended in October 1999. On Jan. 12, the United States Supreme Court upheld the Drivers Privacy Protection Acts constitutionality In Condon vs. Reno. The court stated, in part: Under the amended DPPA, states may not imply consent from a drivers tenure to take advantage of a state afforded opportunity to block disclosure, but myst rather obtain a driver's affirmative consent to disclose the drivers personal information for use in surveys, marketing solicitations, and other restricted purposes. The federal Drivers Privacy Protection Act and Utah SBrl74 permit the following access to motor vehicle records: By the person who submitted the information in the record or, in the case of an incorporated business, an officer of the corpora- or used to lished, contact individuals.
