advantage of the tranquility of the lake Today visitors areouton the lake in the summer hikingand horseback riding in the fall and roaming ' the more than 400 miles of groomed snowmobile trails in the winter “We’ve had an increase in visitors over the last three yean” said Judy Holbrook tourism director for the Bear Lake Convention and Visitors Bureau “The Utah side has gone up by about 5 to 10 30 pleaded guilty Jan 16 to killing Tnsha Autry of Hyrum Authorities believe Autry died June 24 2000 after being beaten to death and dismembered by Nielsen Autry was missing for nearly a year before pieces of her remains were unearthed in May 2001 at the Predator Research Laboratory in Millville where Nielsen use to work e Because of the plea agreement a felony charge of obstructing justice and a felony charge of desecrating a dead human body were dismissed and the county attorney’s office agreed not to seek the death penalty However when the plea was withdrawn earlier this month those charges including the possibility of Nielsen being sentenced to death were reinstated The videotaped conversations in question occurred between Nielsen and Cache County Sheriff Chief Deputy Bob DeGasser and Sgt Chad Jensen Jan 20 and Jan 22 the week after Nielsen initially pleaded guilty “There wasn’t much of a confession unfortunately Jensen said in February “ He had talked to us given us his version of what consisted of (Autry’s death) an accident and that was the gist of the tiling There were things he wouldn’t admit to” A partial transcript of the interviews has Nielsen denying he made cuts to any of Autry’s bones after he allegedly burned and buried her body and then dug her up again “The cuts on these bones It bothers me more than you can imagine” Nielsen states “ It really bothers me that they’re saying it’s cuts there and I know there ain’t” ' During the interviews Nielsen also stated he’s glad Autry’s partial remains were found “cause to be honest with you Chad I probably wouldn’t have made it much longer I want tried to commit suicide several times ” The interviews lasted a total of six hours over the y period In his motion Daines argues in part that the suppression of the tapes should be overturned because Nielsen initiated the discussion with investigators that on both occasion he was second-degre- third-degr- ee hap-whi-ch ' read his Miranda rights that Nielsen knowingly made an intelligent decision to speak with investigators without the presence of his lawyers and that he knew' the conversations would be reported in frill to the prosecution “In tiie immediate case Chief Deputy DeGasser and Sergeant Jensen did not violate the law” Daines argued “They intentionally delayed talking to the defendant until after he had a chance to compose himself and reconsid- ra talking They treated him with respect They went overboard in advising him of his Miranda rights etc As a mkter of public policy this behavior should be encouraged not punished” Nielsen’s Attorneys David Perry and Shannon Dernier have two weeks to respond to Dailies’ motion “We’ll argue that the judge has already ruled on this issue” Perry said ” We’ll make an argument under Miranda vs disagrees that Nielsen initiated the conversations with investigators and that he volunteered information about Autry’s death “I sent them (the county attorney’s office) a letter saying that if you want to talk to him (Nielsen) I want to be present and that he’s invoking his Fifth Amendment right and Sixth Amendment right to counsel” Perry said Because he feels the videobiped conversations violated Nielsen’s rights Perry said he plans to file a motion asking Judkins to punish the county attorney’s office “We feel this violation of his Fifth and Sixth Amendment rights is so egregious that the state v should be punished by keeping it (conversa-tions)oeven if he takes the stand” Perry said “We’re going to go that one step further and say even if Cody takes the stand they should not
