No Smoking The Law 76-10-106 (4) (a) is as follows: (4) A person may not smoke or use tobacco in any area of the following Utah's new smoking law took effect on January f, 21995. . . Smoking tobacco products will be against the law in Utah's schools, and on school property, beginning New Year's Day. The new law contains heavy penalties. Anyone who violates the no smoking statue will be subject to a civil penalty _ PAGE 8 of $500 to $2,000 for the first violation. A second violation raises the penalty range to $2,000 and not more than $10,000. The law calls on educators who spot a person "in possession of a lighted tobacco product" to request the person to extinguish that tobacco product. The law declares that if the person fails to comply, others present "shall ask the person to leave the premises". The state and local health departments will enforce the law, notify alleged violators, conduct hearings and impose penalties. Your school board is requiredto comply with this 1aw and are requesting that all patrons of the school district respond with behavior that is respectful of the law and respectful to the rights of all.
