They wanted to stop Beyond the Valley of the Dolls from lieing shown and now they have a chance. National General Corp. wants to take its film and get out of the state so what is Salt Lake trying to prose by getting an order to make it stay? If they should possibly get a conviction, the maximum penalty is a fine of up to $299 and jail sentences of six months, or lioth, and the film will lie destroyed. If they let it go by itself they are going to save the taxpayers a lot of money and the city attorneys office a lot of time. So now we are back where we started. Or are we? There has lieen so much publicity alxiut this film with all the charges leveled and counter charges, the comments of the Safety Commissioner, that it is very possible that the revenue the theaters will take from the film will far exceed exiecta-tion- s and the normal receipts the film would have grossed. For example on the Saturday following the first proceedings taken by the city, Ted Kirkmeyer announced that the film grossed $5(KX) for that one day, a record for the Salt Lake area. The night before there had lieen considerable publicity on the television news and in the papers. UNDOUBTEDLY THERE have lieen worse films to come to Salt Lake. Why was this we singled out? Jones ruled that the city did not have enough evidence to indicate the film was obscene and that they should confiscate it. It is in the opinion of the court that the burden (of proof needed to proceed further) has not lieen met by the city at this time. I feel that there is insufficient evidence. This does not preclude the city from proceeding further if it wishes to proceed further, he said. This touched off outrage and accusations from the Office of the Public Safety Commissioner James L. Barker. Barker said the film was oltscene and onlv a pervert would see a show like that. THE CITY wished to proceed further against the film. A short while after Judge Jones' ruling, the City Commission unanimously directed the city attorney's office to do everything possible to institute new court proceedings to stop the showing of the film. While all this was happening in Salt Lake City, a complaint was filed in Fourth District Court (n Provo claiming that the film was obscene under the definition of oliscenity 1. This states that found in the Utah Code annotated the word oliscene dial have the following meaning whether to the average adult person, applying contemporary community standards, the dominate theme of the material of the conduct taken as a whole appears to prurient interests. Judge Joseph E.
