The three told the Court of visits made to the Munk farm, in which efforts were made to make the proper measurements. But each time, they said, their efforts were ' unsuccessful when Munk refused to cooperate by giving them permission to get on his land. The ASC had alltoted Munk 22.7 acres for wheat production. This figure was arrived at by the committees use of a 1957 aerial photograph of the Munk farm. This has been the basis of his acreaage allotment by the committee for the past two years. Last May 19, Munk paid a penalty of $358.61 for overplanting of 11.6 acres in 1958.
