The land In question has been Involved in litigation for more than thirteen years. The affected property lies in the southeast quarter of section 111, township 13 south, range 8 eastdis-of the Balt Lake meridian. The pute over ownership arose between the state nnd the federal government after the state land office had sold the property to William O. Williams and T. A. Ketchum. On July 23, 1111, after the sale had been negotiated by tha state, Cyrus W. Shores filed petition with tha federal land office to buy the property. The state resisted Shores' application and claimed ownership. In aupportlng its claims, Utah asserted that tha lands were not known to be mineral at tha time of survey, nnd that it therefore acquired title under the school land grant Jaunary 4 1S9C. The present decision held that tha state did not acquire title under the school i.ind grant, but that It had acquired title under tha Jonm bill, which became effuctlve January S3 19! After the state's flret sale the property wee purchased by the Ketchum Coal company.
