SALT LAKE CrTY, a municipal corporation of the State of Utah, et al, Plaintiffs, TAMAR ANDERSON, et al, Defendants. IN 1972 77. IN WITNESS WHEREOF, I have set my hand and official seal this 24th day of April Ex-Offi- Coalville, Utah 377 THE MATTER OF THE GENERAL DETERMINATION OF RIGHTS TOTHEUSEOFTHE WATERS OF UTAH LAKE IN UTAH COUNTY, UTAH AND OF THE JORDAN RIVER IN UTAH AND SALT LAKE UTAH, AND COUNTIES, their tributaries. IT APPEARING to the Court that while the above-entitl- ed action was initiated to quiet title to the rights to the use of water from Utah Lake and its tribby order dated September 1,1944, direct- utaries this Court, ed that this proceedings can be converted to a statutory determination of water rights and to thereafter proceed in PROPERTY ASSESSED TO: DESCRIPTION 5. HE-A-3- nch 00 M4-59- division cont. 1.45 ac., accordance with Chapter 4, Title 73, Utah Code Annotated 1953, as amended. IT FURTHER APPEARING that some question exists concerning the scope of this proceedings because said prior order provides that said gen- -, eral determination proceeding) should encompass the rights to the use of the waters of Utah Lake in Utah County and Hie Jordan River in Utah and Salt Lake Counties and their tributaries. However, the State Engineer of Utah, in a verified petition dated April 3, 1972 alleged that in order to provide for a complete and compre hensive adjudication ofthis drainage basin and in order to provide for a proper correlation of all existing water rights and prevent a multiplicity of lawsuits, it is necessary to adjudicate all of the tributary sources of Utah Lake and the Jprdan River as well as the groundwater supply underlying this drainage basin in this proceedings. Certain of these trlb-.uta- ry sources are located within Davis, Summit, Wasatch, Sanpete and Juab Counties. The State Engineer requested this Court to clarify the scope of this proceedings and specifically direct that this action encompass all waters within the Utah Lake and Jordan River drainage basin, both surface and underground. THEREFORE, upon motion of the Attorney General for the State of Utah, Attorney for the State Engineer and good cause appearing therefore: IT B ORDERED: 0) That notice of the petition of the State Engineer be given by publication of this order once a week for three consecutive weeks in the following newspapers: Daily Herald, Provo, Utah; Deseret News, Salt Lake City, Utah; Wasatch Wave, Heber , Utah; Davis County Clipper, Bountiful, Utah; Summit County Bee, Coalville, Utah; Nephi, Nephi. Times-Ne- ws, Utah; and the Manti Messenger, Manti, Utah; and (2) That a hearing is set at 9:00 a.m. on the 9th day of May, 1972, at which time any interested party may appear and present evidence showing why the petition of the State Engineer should not be granted and why this proceedings should not hereafter encompass, and be designated as, In the Matter of the General Determination of the Rights to the Use of all the Water, Both Surface and Underground, Within the Drainage Areaof the Utah Lake and Jordan River in Utah, Salt Lake, Davis, Summit, Wasatch, Sanpete and Juab Coun- ties, Utah. , Dated this 5th day of April, 1972.
