Roth and Associate Justice Macklin Fleming, confirmed the judgment handed down by Superior Court Judge Charles C. Stratton in October, 1970, who held that school boards could not enter into collective bargaining contracts with teacher unions, could not recognize any union as the sole bargaining agent for teachers, and could not enter into binding arbitration with teacher organizations. What happens next? We do not know, as we go to press, whether UTLA will take the case up to the State Supreme Court. If they do, they will first have to petition the Court for a writ of certiorari, which is, in effect, permission to file an appeal before that body. It would be up to the Supreme Court to decide whether to hear the matter or to let the Appellate Court decision stand. Whatever happens in the future, the present situation is that the Stratton decision holds not only for Los Angeles, but for the whole State of California. The Glendale Teachers Association has presented a list of demands to the Glendale Board that makes the n UTLA contract seem like invitation to tea. But that question has now become academic. Let us bow our heads and pray for the repose of the NEA, CTA, GTA, UTLA, et al. Violated Oaths Dear Editor. Robert J. Stewart, owner and operator of Bobs Country Store in Gilbert, Arizona today filed a civil rights suit for violating their oaths of office against Harold Martin, Robert Meyers and Paul, W. LaPrade, all judges of the Maricopa County Superior Court, against Attorney General Gary K. Nelson and Assistant Attorney General William J. Schafer III, and against Arizona Wants Revolution But Lacks Goal Tax Commissioners, L. Waldo DeWitt, John M. Hazelett and Bob Kennedy. All Defendants were when they challenge, unconstitutional laws. In order for the Citizen to maintain his rights and exercise control over government one particular organ of freedom must be intact. That organ is the Jury. Either by- neglect or planned indoctrination the definition of the Jury under Common Law has been succeed - changed. According to Lysander Spooner in his excellent treatise. An Essay on the Trial by Jury, The trial by jury is a trial by the country that is, by the people as distinguished from a trial by the government. It is fundamental that we regain the Common Law function of the jury if we are to regain our rights as United States Citizens. Again Mr. Spooner says, The object of this trial by the country, or by the people, in preference to a trial by the government, is to guard against every species of oppression by the government. In order to effect this end, it is indispensable that the people, or the country, judge of and determine their own liberties against the government; instead of the government's judging of and determining its own powers over the people. How is it possible that juries can do anything to protect the liberties of the people against the government, if they are not allowed to dtermine what those liberties are? Today, we have, almost always, only the trial by government. This of type trial is to unconstitutional according Amendments VI & VII written in the Bill of Rights. He says, From the s, the distribution to the of wealth in this country did not of the change. He thinks there should be less secrecy in government, including wartime. Can a people operate effectively against a strong enemy if they reveal all their plans and methods of procedure through continued public debate? not some concentration of power permitting secrecy and speedy decision and movement necessary in wartime? He says, No education. My father taught one term of this school at a salary of $20 a month. Yet nearly all the youngsters in that community became citizens. Some of them achieved outstanding success, They didnt know they were poor and deprived. They went without rubbers and overcoats. They were scantily clad and poorly nourished, but they studied, worked, learned, did not get into trouble and became worthy citizens. 1 am not advocating that kind of life, but mention it to show that family income or the amount spent on education is not as important as many seem to think, self-respecti- ng self-supporti- ng, The minister long-cynicis- m. an quotes economist, that everyone who operates privately really is aided and subsidized, to one degree or another, by the public."
