Niendorff, an airline captain from Belleview, Washington, has recently filed a lawsuit in the Superior Court of the The 0DM&idependent 2459 Major Straat, Silt Laka City, Utah (4115 3 Talapkoaa 466-191- December 26, 1972 Governor Calvin L, Rampton State Capitol Building Salt Lake City, Utah .i Dear Governor Rampton: A of the so-call- ed few days ago we read in the daily newspapers of your intention to urge passage " Equal Rights Amendment" in your forthcoming message to the State Legirequest that you take a closer look at this proposed amendment and ponder some slature, We of the undesirable elements inherent therein . We further urge Amendment be a woman. Rights since it ? the State Legislature to turn down the Equal will rob the women of Utah, and the nation, of the right to you to call Happy Juror Demands Gold upon Since this matter is soon to be considered by 29 of the 50 State Legislatures throughout the country (the Amendment has already been ratified by 21 states) , you would be performing an outstanding service to the women of the State of Utah if you would direct a letter to the Governors of those 29 states urging them to ask their state legislatures to refuse to ratify this Amendment, We feel this would not be out of order since you have established a rapport with the other governors at the annual meetings of the National Governors Conference where national issues are regularly discussed . Constitutional authorities such as Professor Paul A . Freund of the Harvard Law School and Professor Philip B, Kurland of the University of Chicago Law School have written against the Equal Rights Amendment, They pointed out in the Harvard Civil Rights-Civ- il Liberties Law Review that the ERA will make women subject to .the draft and combat duty ; will take away the right of women to be supported by their husbands by making them 50 responsible for the financial support of the family thus upsetting the traditional family relationship; and will further reach into the depths of the lives of Americans to create a drastic change in the marriage relationship which will further weaken that relationship in a day when it needs to be strengthened instead . State of Washington against King County and its treasurer. It seems that Mr. Niendorff was happy to fulfill his civil duty as a juror but was not satisfied with the paper money with which the county wanted to pay him for his duties. Mr. Niendorff claims that the Constitution of the United States, Article 1, Section 10, specifies that only gold or silver shall be legal tender. And, furthermore this section has never been deleted. Win or lose, the case of Niendorff vs. King County is likely to reverberations. have nation-wid- e since tens of thousands of For, Americans know that our currency is in fact illegal, and that both federal and local governments are invading their rights in many areas, this case might trigger tens of thousands of lawsuits against municipal, state, county, and federal governments. For example, when a citizen receives any c1 such as an income tax r.'una, ne could demand gold or silver for the amount and file a lawsuit if his demands were refused. Very interesting. Maybe it is time the politicians and bureaucrats started following the law. This case is very interesting, and the Utah Independent is contacting Mr. Niendorff for further details. C Professor Kurland reinforced his opposition to the ERA when, on June 5, 1972, he sent a telegram to the Illinois Legislature which was debating the Amendment at that time. In the telegram Professor Kurland said: "Regret inability to appear before your Committee on Equal Rights Amendment because I think that it is largely misrepresented as a women's rights amendment when in fact the primary beneficiary will be so-cal- led I men, opposed to am its approval," are enclosing a copy of the December 21st issue of the UTAH INDEPENDENT whose lead article was written by Phyllis Schlafly in opposition to ratification of this Amendment, We ask you to read it and then act upon it by reversing your presently announced position on this matter.
