The complaint alleges that the articles were misbranded and had that we are guilty. 1 Illinois Public Health Department placed an embargo on more than SO cases of the Inland Sea Water product. May 12, 1972 later date Hartley Anderson received word from his distributor in Portland, Oregon that the health department there had taken similar action to prohibit the sale of all the TM Research, Inc. products that the distributor had in stock. The health department officials in Portland said that their actions resulted from a request made by the Portland FDA office which claimed that the action was initiated by the FDA in Salt Lake City. Hartley Anderson claims that he went to the Salt Lake office of the FDA at 2738 S. 20th E. and asked why the FDA had instigated the embargos against his product in Illinois and Oregon. He says he was told that the Salt Lake office did not start the embargo against his product and they had no knowledge of what had been done. Several days after a visit to the FDA office Mr. Anderson released the following statement to the Utah Independent: This seizure is in effect a fine. They seized the products toe will have to- pay for. 'It has damaged - our reputation with the distributors. They have presumed : We any reimbursement. We cant even find out to this date what the charges are against us. We went to the local office here in Salt Lake City and asked the Food and Drug Administration if we could look at our files. We were informed that the files are kept in secrecy that nobody can look at the Food and Drug Administrations files. Anderson went on to explain that he had been closed out of business in the Northwest and the Midwest. If we cant get over this hurdle, said Anderson, it will bankrupt us. This is our sole means of income, and we are hurting. They have confiscated our property. We havent been able to face our accusers. If we do fight this in court, we are obliged to pay for all the attorney fees. Mr. Anderson expressed his complaints to the people in the Oregon health department and they admitted they had acted at the instigation of the FDA without even being told what the charges were against the product. Seemingly as a result of Andersons complaints to the Oregon officials, court action against the TM Research products has very recently been filed in the U.S. District Court in Oregon, with Assistant U.S. Attorney Donald H.
