In a 1971 decision of the U.S. Supreme Court, federal agents were denied the protection they have previously enjoyed under the concept of sovereign immunity. Federal statutes have held in the past that the government and its officials acting in their official capacity were immune to suit for their actions on the grounds of sovereign immunity. Sovereign immunity originated in the days of King George on the theory that the king can do no wrong. This concept seems to be losing its status. In their decision, known as Bivens v. Six Unknown Agents of the Federal Bureau of Narcotics, 403 U.S. 388, the court gave the sovereign immunity concept a slap in the face by ruling that federal agents can be held responsible for their personal acts even though they have reason to believe their acts arc justified. In the Bivens case, six federal agents entered a home without a legal warrant, made a search, and then arrested Bivens, who was sub- sequently exonerated from the charges. Bivens then sued each of the federal agents personally for $15,000 damages. The majority opinion, rendered by Justice Brennan, reversed the lower courts decision, Chief Justice Burger, in dissenting, stated that Congress had never authorized citizens to seek such relief against federal agents. However, the majority of the court stated that money damages was a traditional remedy for which no legislation is needed. Justice Blackmun also dissented. Most experts on constitutional law look upon the decision as attempting to recover damages from the United States but from the federal agents as individuals. Justice Brennan stated, The is whether the petiquestion tioner, if he can demonstrate an injury consequent upon the viola-tio- n by federal agents of his Fourth Amendment rights, is entitled to redress his injury through a particular remedial mechanism normally available in the federal courts.
