Defendants and Appellants. CROCKETT. Juatice; Plaintiff bank sued defendants to recover the balance .due on a "master charge card" account which the bank (its predecessor, Granite National Bank) had issued to the defendants. .Defendants answered, admitting the account hilt disputing the amount thereof; and also filed a counterclaim for damages alleging that they had been slandered by the bank's making statements impugning their credit, and had been embarrassed in their attempts to use the credit card after the bank's alleged wrongful termination of their credit thereon. Pursuant to appropriate motions, and a trial before the court, it dismissed defendants' counterclaim. On the basis of the evidence the court computed the balance defendants owed on the account to be $723. 03, entered judgment for that amount, and allowed interest as provided by the contract, plus $350 as a reasonable attorney's fee as agreed to in the application for the account. Defendants appeal. Plaintiff bank called defendant Charles R. Kennedy as a witness. He identified a letter he had written to the bank. It showed that the balance would be as the bank contended if a certain check of his had not been cashed and applied to his account. He also acknowledged that the check had not been so cashed, and that he had in fact stopped payment on the check. There is a reasonable basis in the evidence to support the findings of the trial court. Under traditional rules they should not be disturbed. As to the counterclaim for slander, the specific charges were; First, that on an occasion when Mr. Kennedy was in the bank one of its employees stated in a loud voice and in the presence of others that Mr. Kennedy "was one who caused a lot of trouble. " The other was that because their credit had been cancelled without justifiable cause and without notice, defendants had suffered, public embarrassment in attempting to use the master charge card and being refused credit. Without going into any other aspect of this counterclaim, it is deemed sufficient to state; That in response to interrogatories concerning those allegations and the dates thereof the defendants' answers placed them at a time more than one year prior to the filing of the counterclaim. The trial court therefore correctly ruled that the Statute of Limitations, Sec. U. C.A. 1953, pleaded by the plaintiff, was a bar to the asserted cause of action. . Judgment affirmed. .
