Womack teatified that during the lunch ahe observed Benny C. move from one chair to another at hia table; during this transfer of hia position, Benny came within close proximity to her purse. Benny's party departed from the establishment. Subsequently, Mrs. Womack discovered that her purse was miaaing; included in the contents of her handbag waa an unsigned Master Charge credit card issued to Jean Womack. At approximately 8 o'clock that evening Benny C. .in the company of hia luncheon partner, the young lady entered the retail establishment, Jack E. Wolfe's Sportswear. A saleslady observed the two chatting together and looking around the store. They went to the lower level, where the restrooms were located and then aeated themselves by the receiving desk. They returned to the upper level and proceeded to examine leather pants and jackets. Benny brouaed among the costa, while the young lady selected a pair of leather pants and expressed a desire to purchaae them. The young lady inquired whether the store accepted Master Charge. Upon an affirmative response the young lady accompanied the saleslady to the desk, removed the card from her purae, and presented it. The saleslady wrote out the ticket, and the young lady signed the name Jean Womack. Her signature matched ttye one on the credit card. During this transaction Benny C. waa next to the young lady at the desk. n Where thousands of listeners enjoy concert music and news every day! Mid-We- st -8. Since the purchase was in excess of $50. 00, the transaction had to be verified by Master Charge. During the delay Benny wandered through the store and approached the merchandise located toward the front; the young lady thumbed through a catalogue; both appeared quite jittery. In the interim, the improper uae of the credit device had been discovered, and the police had been summoned. However, by this time the couple had departed from the store. The saleslady was preoccupied on the telephone and Aid not observe their exit from the premise a. Benny was apprehended by the police a short distance from the store; he was walking down the sidewalk, close to the adjoining buildings. He waa taken back to Walfe'a where he was identified by the saleslady. Jr. Office On appeal, Benny contends that the evidence was insufficient i matter of law to prove beyond a reasonable doubt that he aided and abetted another in an attempt to use a credit card without proper authority. Benny urges that the only evidence to connect him with the crime committed by the young lady was hja presence with her, both when Die purse was discovered miaaing from the reataurant and when the young lady attempted to use the credit card. He claims that such evidence ia in sufficient to indicate criminal participation, i. e. , aiding and abetting. Section 76-1-- 44, U.C.A. 1953, provides: All persona concerned in the commission of a crime, either felony or misdemeanor, whether they directly commit the act constituting the offense or aid and abet in its commission . . . are principals in any crime so committed. Benny's presence, companionship, and conduct before and after the offense were circumstances from which hia participation in the criminal intent The order of the Juvenile Court could properly be inferred by the fact-finder.
