In approving or disapproving the plan of a trailer court, the Planning Commission and Health Officer shall be guided by the following requirements: hard-surfac- ed AN ORDINANCE DEFINING AND REGULATING TRAILER HOUSES AND TRAILER COURTS WITHIN THE UNINCORPORATED AREA OF DUCHESNE COUNTYi ESTABLEHING MINIMUM STANDARDS GOVERNING THE INSTALLATION AND MAINTENANCE OF TRAILERS AND TRAILER COURTS AND THE CONSTRUCTION AND MAINTENANCE OF UTILITIES AND FACILITIES TO MAKE SUCH USES SAFE, SANITARY, AND FIT FOR HUMAN HABITATION; PROVIDING FOR THE ENFORCEMENT AND ADKflNBTRATION OF THE ORDINPROVIDING PENALTIES ANCE; FOR THE VIOLATION THEREOF; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF DUCHESNE, UTAH, ORDAINS AS FOLLOWS: CHAPTER L TITLE - DEFINITIONS Thia ordinance shall be known as the "Trailer Court Ordinance" at Duchesne County, Utah, and may be so cited and pleaded. 1- -1. COUNTY HEALTH 2. DEPARTMENT; The County Health Department of Duchesne County. COUNTY; Duchesne, Utah. HEALTH OFFICER; The Director of the County Health Department, or any member of his staff authorized to represent him. 5. PLANNING COMMISSION: The Planning Commission of Duchesne County, Utah. TRAILER HOUSE: A trailer house shall be construed to Include any vehicle or conveyance, or detachable part thereof, which is designed for or which is used for a living or sleeping place for one or more persons. Notwithstanding the removal of wheels or the placing of a trailer house upon a foundation or other structure, such trailer houses shall be defined as a trailer house for the purpose of this ordinance. "Trailer House" shall be deemed to be synonymous with "Trail Coach", "Mobile Home", "Sheep Wagon", "Home on the nnge", "Camper", or such other homes as may be used for such vehicles. 7, DEPENDENT TRAILER HOUSE: A trailer house which does not have a flush toilet and a bathtub or shower "built in" as an integral part thereof. 8. DEPENDENT TRAILER HOUSE SPACE; A lot, parcel of land, or space which is properly equipped with sewage disposal facilities and which is prepared in accordance with the requirements of this ordinance as a space for the parking of a dependent trailer. 9. INDEPENDENT TRAILER HOUSE: a trailer house that has a toilet and bathtub or shower 'built in" as an integral part of its equipment and which facilities are usable and in good working order. INDEPENDENT TRAILER HOUSE SPACE: A lot parcel of land, or space designed for, or offered for use as, a space for the parking of a trailer house, which space is provided with or is connected to water and sewage facilities which have been approved by the Health Officer. TRAILER COURT (TRAILER PARK); Any lot or parcel of land, whether for rent, lease, hire or gift, where two (2) or more trailer houses are parked and used for living andor sleeping purposes; Including any buildings, structures, vehicles or enclosures used or Intended for use as a part of the equipment of such trailer court. "Trailer Court" shall be deemed to be synonymous with "Trailer Park" or "Camp", or such other names as may be used in connection with the use as defined herein. TRAILER HOUSE SPACE: A plot of ground within a trailer court designed for the accommodation of one Q) trailer house. TRAILER STAND: An area within a trailer house space on which the trailer rests. A building housing toilet SERVICE BUILDING: and bathing facilities for both men and women, laundry facilities and other facilities for the use of occupants within a trailer court. CABANA ADD-OA building or shelter con structed on a trailer house space and used for storage or shelter purposes by the occupants of the space on which the cabana or add-o- n is located. SCREENING: The use of any structure or material primarily for the purpose of obstructing vision. 1- -3. 1- -4. 1- -6. v 1 LOCATION AND PLAN MUST COMPLY WITH ZONING ORDINANCE. The location and plan must comply with all of the requirements as set forth in the Zoning Ordinance of Duchesne County, Utah, pertaining to the zone in which the trailer court is located. The site of any trailer court shall be graded andor filled and maintained so as to prevent the accumulation of storm or waste water of any kind, and no trailer court shall be permitted in low, swampy places where the ground water causes the surface soil to become wet. Protective slopes away from all patios, trailer house stands, and buildings shall be provided to assure immediate drainage and diversions of surface water away from these facilities. ROADS: Each trailer space shall be accessible to an access road of at least twenty-fo(24) feet in width. Each access road shall provide continuous forward movement and shall connect directly to a public major or collector traffic street which is not less than fifty (50) feet in width. Where any access road connects to two or more public streets, such roads shall be arranged so as to prohibit through traffic. All access roads must be graded, graveled and surfaced, as approved by the Building Inspector. GENERAL: CONSTRUCTION: habitation or shelter or of constructed rags, brush, cans, weeds, sacks, storage facility or refuse material, or any combination of the foregoing shall be permitted, and it shall be the duty of the owner or operator, where such construction exists, to have the same demolished and removed from the premises. Any portion of, or appendage, or any habitation, shelter, or storage facility shall be comparcanopy, cabana, add-o- n able to and in excellence of quality, construction and workmanship as required by the Building Code of Duchesne County, Utah, as determined by the Building Inspector. It shall bo unlawful to construct any habitations, shelters, cabans, add-oor storage facilities without first obtaining a permit from the Building Inspector of Duchesne County, Utah. -1. No ns CHAPTER 3. LOCATION AND GENERAL LAYOUT OF TRAILER COURTS GENERAL: PLANNING COMMISSION AND HEALTH DEPARTMENT APPROVAL OF LAYOUT REQUIRED BEFORE CONSTRUCTION: Any person, firm or corporation wishing to construct a trailer court within Duchesne County, Utah shall submit an application for a permit therefor to the Building Inspector 3-- 1. -1. of Duchesne County. All plumbing In the trailer park shall romplv whh the State numbing Code. GARBAGE COLLECTION: Garbue collection facilities shall comply with the rules and regulations of the State Health Department. Racks or lioldcrs shall be provided for garbage receptacles having a clear space of twelve 02) inches beneath the racks to facilitate cleaning and to prevent rodent harborage. Such racks shall he so designed as to minimize spillage and container deterioration. All receptacles shall be water tight, fly and rodent-proo- f. SIGNS: Signs sliall be placed in all trailer courts (where applicable) indicating the direction to and the marking of rest rooms, toilets, laundry and other service buildings as required by the Building Inspector. PARKING: Sufficient areas should be provided for the parking of motor vehicles to accommodate at least as many vehicles as there are trailer spaces within the trailer court. Common or collective parking space for two (2) or more trailer spaces may be provided, but all parking spaces must be located within one hundred Q00) feet from the trailer space it is designed to serve. LAUNDRY DRYING: Clothes line space for the drying of laundry shall be provided, at the ratio of seventy-fiv- e (75) lineal feet at clothesline for each trailer space, except that gas or electric clothes dryers may be substituted for clothesline space at the ratio of one such dryer for each 2,000 lineal feet of required clothesline space or fraction thereof. Where such clothesline space is provided, either as individual or common facilities outdoors, it shall be located and screened so as not to impair the view from streets A combination of clothesline space and or trailer houses. clothes dryers may be used. The limits of each TRAILER HOUSE SPACE: trailer house space shall be clearly marked on the ground by permanent flush stakes, markers, fence or other suitable means. No trailer house space shall have an area, or length, less than the dimensions necessary to accommodate the minimum requirements of a trailer house stand, patio, cabana, and the required yards as set forth in the or other add-o- n, Ordinance. LANDSCAPING: Front and side yards between trailer houses shall not be used for the parking of vehicles but shall be landscaped with lawn, trees and shrubs, rocks, sand hard surfacing or a combination thereof. Plans shall show the type and nature of the landscaping which must be approved by the Duchesne County Building Inspector before a permit for the trailer court shall be issued. It shall be a continuing obligation of the owner to maintain the landscaping and other features of the plan as approved. It shall be deemed to be a violation of this ordinance for any owner of any trailer court to permit the parking of vehicles within required front and side yards or to permit the plantings to die without replacing them, or to change the landscape features without first obtaining approval of the Building Inspector. -6, -7. -8. -9. 3-- 2. From trailer house stand to the nearest part of another trailer house stand on opposite side of road: Forty (40) feet minimum. b. Between a trailer house and a parking area: Five (5) feet minimum. c. Between a trailer house and a public street: At least fifty (50) feet. d. Between the side or back of any trailer house and the boundary of a trailer park: Twenty (20) feet except that the Planning Commission may require ornamental screening. e. Trailer house stands shall be located not less than twenty (20) feet apart from side to side and not less than twenty (20) feet apart end to end. No trailer shall be located closer than twenty (20) feet to another trailer, except that the Planning Commission may require wider spacing. -2. 3-- 3. CONSTRUCTION ON TRAILER CHAPTER 4. ADMINISTRATION AND ENFORCEMENT 1. ENFORCEMENT OFFICER: It shall be the duty of the Building Inspector of Duchesne County, Utah, to enforce the provisions of this Ordinance. He shall refer all violations of this Ordinance to the County Attorney, entering actions in the courts where necessary and his failure to do so shall not legalize any violations of such provisions nor shall the failure of the County Attorney to enter action in the courts legalize any violation of such provision. The Building Inspector shall cooperate with the State Health Officer in the enforcement of this Ordinance, and no permit to construct or enlarge a trailer court shall be Issued by the Building Inspector until the same shall lie approved by the State Health Officer. EXISTING TRAILER COURTS MUST COMPLY WITH ORDINANCE. Any trailer court which was in exlstance at the time of the effective date of this Ordinance, but which does not conform to the regulations of this Ordinance, is hereby declared to be unlawful and opposed to the health and general welfare of the County and its inhabitants, and shall therefore be considered to be a public nuisance. All such existing trailer courts shall be made to conform with all of the provisions of this Ordinance within two (2) years from the 4-- 4-- 2. effective date thereof. 3. RESPONSIBILITY FOR VIOLATIONS. It shall be the duty of all architects, contractors, builders and other persons having to do with the establishment of any trailer court or the erection, altering, changing or remodeling of any trailer court to see that a proper permit has been granted before such work is begun. Any such 4-- architect, builder, contractor or other person doing or performing any such work without a permit having been Issued is in conflict with the requirements of this Ordinance and shall be deemed guilty of violation at this Ordinance in the same manner and to the same extent as the owner of the premises, and said architect, builder, contractor and other person doing or performing such work shall be subject to the penalties herein prescribed for violation. 4. PENALTY: firm or corporation, Any person, whether as principal, agent, employee or otherwise, violating or causing or permitting the violation of any of the provisions of this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine in any sum not exceeding $299.00, or by Imprisonment In the county jail for a period of not longer than six (G) months, or by both fine and Imprisonment. Such person, firm or corporation violating this Ordinance or any part thereof shall be deemed to be guilty at a separate offense for each and every day during which such violation is committed, continued or permitted by such person, firm or corporation and shall be punishable as a separate offense. The County may also enjoin the violation of this Ordinance. 4-- CHAPTER 5. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. 2. One general purpose room for the housing of private laundry facilities and for toilet and bathing facilities for use in connection with trailer houses which would be classified as a dependent trailer house without such facilities, provided such room complies with the Building Code of Duchesne County, Utah, and does not exceed one hundred Q00) square feet in floor area. d. A canopy may be constructed over a trailer house patio provided such canopy is completely open on all sides except for supporting columns, and complies with paragraph of the Ordinance and approved by the Building Inspector. 4. OVERCROWDING PROHIBITED: R shall be unlawful to allow any trailer house to occupy space within a trailer court which has not been developed as a trailer house space with all required facilities. 5. WATER SUPPLY: An adequate supply of water approved by the State Health Department shall be provided for drinking and domestic purposes. The water supply shall be obtained from faucets only. No common drinking cups shall be permitted. Two (2) cold water supply faucets shall be located on each trailer space and an adequate supply of hot water shall be supplied at all times in the service buildings, where such service buildings are required for bathing, washing and laundry facilities. 6, SEWAGE FACILITIES: Approval of sewage facilities must be obtained from the State Health Officer. 7. SERVICE FACILITIES: All service facilities, whether required as stated herein or otherwise furnished, shall be located and constructed as follows: TOILET FACILITIES: a.
