The measure of the decline is best indicated by tho fart that the average daily rate of rutput in Jannary was less 62,000 tans, or 5.3 per rent, than the rate 'or the month of December. Smith, Mortimer FJeishliaeker and Herbert Fleiahhacker in connection wjth a transfer of stock of tbo Royal Coal company, from Third district court to federal court, was announced last Friday. Tho eoinplaint alleges that the defendants agreed to purchase profer-ree- d capital and conimou stocks of the coal company, a Delaware corporation, from Ballif for $360,000, thus obtaining control of the concern.
