The temporary restraining order against Leland Hair of Duchesne, William Wardle of Roosevelt and R. L. Johnson and Glenn Alexander, both of Vernal, prohibiting them from operating individual truck service between Priee and this city, was dismissed here last Wednesday. The case was heard by Judge George P. Parker of the Fourth district court. The men had been served with a temporary restraining order on November 27th, effective until 6th, but this was within a few days dissolved through the efforts of Attorney Thomas W. ODonnell of Vernal, representing the men named in the order. In this action the Utah public utilities commission was the plaintiff, the restraining order being based on the fact that the defendants had not secured a certificate of necessity and convenience for operating their trucks between the two cities and intermediate points. At the hearing before Judge Parker the commission wag represented by J. Robert Robinson, assistant attorney general. The genesis of the case reverts to the fact that on October 15th of this year the Eastern Utah Transportation company, composed of Eugene Harm-stoLester Mullins, Paul Wilkins and Harry Sprouse, all of Roosevelt, and R. L. Johnston and Glenn Alexander, both of Vernal, was granted a franchise by the commission to operate freight trucks between Priee and Vernal and intermediate points. Shortly after the franchise was granted the two Vernal men withdrew from the company and began to operate their trucks between the two rities without having asked for a franchise from the commission. The Eastern Utah Transportation took nmbrage at this action and lodged a complaint with the ntilities body and the temporary restraining order followed by the hearing here this week er n, was the result. The merchants of Vernal entered the fray by declining to give any business to the Roosevelt concern and by joining the men at whom the restraining order was leveled in contesting the instrument in court when the eases were called for Witnesses and spectators hearing. from every town in the Uintah Basin were in the courtroom Wednesday morning, as every eommunity is vitally interested in the transportation of merchandise and other commodities. The taking of testimony had progressed only a short time when Attorney ODonnell brought to light the fact that certificate of necessity and convenience granted to the Eastern Utah Transportation was not yet in effect by reason of the fact that the public utilities commission had stipulated when the franchise was granted that the latter must establish stations at each of the towns in which they were operating by delivering and accepting for delivery freight and other tonnage, must fix rates and display tariff sheets, and must post notices of the schedule time of the arrival and departure of their trurks.
