The brief was written by Bert L. Penn, counselor of the Traffic Rate and Service company, and was signed by John R. Doolin, executive secretary of the Utah Coal Producers association; H. W. Pricket t, general counsel of the Traffic Rate and Service company, and Milton H. Love, a member of the same organization. The filing of the brief was a result of a recent request of the carriers in which they asked the interstate commerce commission to keep the emergency freight rates from March 31 to a day to be set by the commission. The state public utlities commission and twelve other Utah organizations have also filed formal protest with the I. C. C. urging against any postponements. ' Excerpts from the brief state: "The coal producers are not in sympathy with the transportation of coal by truck from the mines to the consumer, because of its demoralizing effect upon the coal industry and the rail carriers. We prefer to see the tonnage continue by rail, but, if imposition of surcharges prevails, it will be practically impossible. to thirty per cent of "Twenty-fiv- e the coal used in Utah county is being IflUled by truck from the Castle Gate mines, and there have been as many as 100 trucks per day transporting coal through Spanish Fork canyon to Utah point!."
