The action was brought to replevin certain goods held by Sheriff Hancock, and the time for him to enter an appearancs in the case expired on Dee. 1, 1905. On that date his attorney served demurrer on plaintiff's attorney by leaving a copy of the same with the attorney's wife, the nitornev being from hla place of buotnexs. The demurrer was then mailed to the clerk of the court some 60 miles distant for filing. It reached Its destitution on December 4. Ilatntiffs attorney objected to Its being filed as of dat of service, so It was filed as of date December 4, which waa three daya after tha time Hie for appearance had expired. attorney then had the default at defendant entered and proceeded to take default judgment against him. Haycocks attorney objected to default being entered and tendered an answer to the complaint which tho court refused to allow filed. After the Judgment waa enterod'thv attorney for defendant moved to set aside the default and vacate the Judgment and offered affidavits in support of his motion, denetting forth that ha had a good defense to the action. The court nied the motion and this ruling la set forth in tha appeal m error.
