B., a second cousin of Mrs. Mary Baker G. Eddy of Water and Dr. E. J. Ftteter-Eddbury, Vt.,Mri. Eddys adopted son, have become additional parties plaintiff as, "next friends, of Mrs. Eddy to the bill In equity brought to secure an accounting of her property against leaders of the Christian Science church. In Joining In the bill In equity Dr. Foster-Edd- y soya- In his petition that he "has become convinced that Mrs. Eddy Is. and ha been for a long time, incapable of Intelligently con ducting or receiving and accounting for her business and property, and that the same is being managed who! ly by the defendants without giving a proper accounting thereof. Fred W, Baker, In hla petition, says that ha Is a second cousin of Mrs. Eddy and that in September, 1896, he was sent by hls employers to examine and repair and alter certain carriages of Mrs. Eddy. He made known to Mrs. Eddy hls relationship to her and she treated him cordially. Inviting him to remain in the house, which he did one night. She Invited him to visit her, with hla wife and children at any timv Mr. Frye, however, told him that he ought not to make that visit. During the past three years he wrote to Mrq. Eddy twice, offering to avail himself of her invitation to visit her. but he received no reply, and he believed that she was not permitted to dee either of the letters. In September, of 1905, he said he. decided to make an effort to see Mrs. Eddy. He went to Concord and lo her house and Mr. Frye refused him the privilege of seeing her. He believes, he aaya in bis petition that Mrs. Eddy la virtually a prisoner in her own house; that she Is kept secluded by the defendsnts, Frye and others, and that she is not capable under present conditions, of managing her own hnslness. Mrs. Eddy sent her carriage today for her counsel. Former Congressman Henry M. Baker, who made a long call at Pleasant View and on hls return he said he had discussed with Mrs. Eddy both personal snd legal matters. He said that she was In her usual health knd spirits and while she was concerned about the pending proceeding he ritd not think they would have any Injurious effect upon her. Landis ia the United States circuit court, is, figuratively balance. speaking, hanging In the Technical objections almost without number have been raised by stlomey for the detente. While almost all have been overruled, there remain three, still undecided, which, if sustained, will overthrow the entire fabric of the governmenta prosecution. These objection. In brief, are: That the Chicago ft Alton tariff kheets were not. placed In two conspicuous places in the station at Chappell, Illinois. That Chappell is not named In the Chicago ft Alton tariffs as a shipping station, snd, consequently, there to no violation of the Elkins law in the Chicago. March 12 Chappell count. That the government has not shown cent rate on the existence of x 19 oil from Cheppell to St. Louis. Mo., and that the mere filing of the bridge tariffs by the Alton did not constitute the eftabllshnint of such a rate. Of these three objections the first Is the moat Important from the eland-poieffect should of its It he sustained. It has been fairly well established that the tariff sheets were not posted, not only in Chappell but In every station from which the Standard Oil c;'mpiny shipped Its products. If Judge Landis hold, thin neglect of the railroad company absolves the shipper, the prosecution in this caw and those started under all the other Indictments wiil fan ' ' thmnsh.
