J., will resume the stand today and Mr. Jerome will continue the searching which took up practically all of yesterday's session. Dr. Hamilton eras retained by the defense soon after the killing of Stanford White and sawTbaw in the Tombs at the request of Thaw's lawyers. When he examined Thaw It was as a physician in Thaw's employ. There la little chance that the court will now allow him to testify for the prosecution without a specific waiver on the part of the defense. Under the law relations between physician and patient and privileged and a physician can not he compelled to testify against them anil without permission of the patient will not be allowed to do so. If Mr. Jerome calls Dr. Hamilton and questions him, the defense sill, without doubt, object, and the court will probably nphold the objection. Probably tbe only thing that Mr. Jerome cm gain by calling Dr. Hamilton will he the poeilble effect on the minds qf the Jury of the defenses effort to keep him from testifying. Mr. Delmaa stated yesterday that he expected to finish the defense's direct case this week, the sixth of the trial. If this is done.
