Powers and C. C. Richard. Messrs. Kimball. Maglnnis. and lleywood represented the The Hul-auU- lonirslee. Powers said that certain Judge amendments to the complaint would be submitted, lie argued that it was almost impossible to contest the validity of an election if a technical and strict construction of the statute were adhered ta Counsel claimed that the stature on election oontesta mut be liberally construed and must be so construed that effect will be given to ita provisions. The statute would he rendered null and void if it wera necessary secure a conviction upon the which provided that a contest should be brought within forty days from the date of election. Judge Powers referred to a number of authorities in support of hia contentions. Counsel rend from a Wisconsin report, Ihe decision of a Judge who held lhst a vote given in consideration of any promise, remuneration or reward, is void. Upon the point (hat it was not necessary to allege and prove a conviction, Judge Powers read extensively in support of the same from different slate cases. After concluding bis argument, he rend the amendments to be offered to be complaint. In all there were nineteen amendments offered, nunc of which, it la claimed by the contestant, ffects the materialityof the complaint, lbs charges in a number of instances srs made more specific and the result is aa amplification of a number of paragraphs in the complaint Paragraph I ia the complaint was subjected to the moat amending. Subwaa division D of this paragraph n tj 1 amended to read: 111 at the ell has given and offered said How- to give to divers and sundry electors and registered voters within the Second JuJiciel district, by himself and through other petwoni acting for and la his behalf, to wit: William Holmes, Joseph Rhoades, John Burt, lira. Charles Andsraon, John Doe and Rlch- and Roe and divers other persons and electors, whose other and true names are to contestant unknown, large sums of money, property, and other things of value for the psrpose of thereby procuring their special votes for him and for his election and for the purpose that the same or some part thereof should be used by said electors for the purpoee of procuring ihe election of said Howell and for the further purpose of bribing said electors within said Second Judicial district to cast their votes for said Howell at said n, Syl-van- us election. The words most widely inserted in tbs amended complaint are to contestant unknown;" other words amplifying the statements are inserted in various places. i. thec-on-ieste- gave the doting mi the objection to the amendment, lie said that there is a broad doctrine laid down by the auiboriiie that no new mailer can be put into the complaint after it has once been ItYd. He claltn-tint the amended mniplaiiit of the contestant was au entirely different, proceeding to the original. He said that there had not been one atlidavlt prweured or a scintilla of evidence to the court to show that contestant was not just as writ prepared at the time the complaint was filed a they are now. It would sera that counsel has been negligent in the matter. Judge Maginnis stated ihaL lie bqd one or two points to pre-ebefore the arguineut or the objection closed. He argued that the contestants had Inserted an omnibus clause in the romplaiut which took in a great number of people, making a new cause of action. Each alleged bribe wss a separate offense and proceedings coul.l have been intituted upon any one sud that would have been sufficient if proved, to oust the contest ee. Judge Morse then said that inasmuch as It whs almost 5 oclock an adjournment would be taken until 10 o'clock Thursday morning, at which time he would render a decision as to what amendment would be allowed. d eil nt BEET CONTRACTS Field Superintendent is Now Making Contract! With ths Farmers. The Ogdeu Sugar Co. is getting con tracts printed, preparatory to making contracts with the farmers to raise sugar beets for the coming season. The field superintendent can be found on each Saturday at the company's office commencing Feb. 11. Each former 1 requested at once to make up his mind how many acres of beets he will plant this season and not put off his declsiou until loo late in thn season. The company should have the contracts In, so they can tell about March 1 what acreage tliere will be. Then. If any more drills are needed there will be time to gel them and have more drills and aeed la readiness for the spring's work. The experience the farmers have had In the beet business for several years has taught them, so they are not strangers to the work, and they know about what (hey will get from an sere of land. The best land should be selected, and fertilised if necesary, so that good returns wll) be rvaJlxed. This crop is not a drug on the market, and ia always worth the price expected In the fall, but this cannot be said of all Ilia crops the farmers grow. Sometimes they get a fair price and ready Mil and at other times poor prices and hard to dispose of. But not ao with sugar beets No mattor If augur is high or low, the farmer gets the contract price just the same. On Monday next, Feb. 13, the field superintendent will visit Riverdale at 2 p. ni.. for ihe purpose of making beet contracts for Ihe coming acason.
