Kuhn and Bra, to recover $1,425,-0alleged to be due him for salary and commission. The complaint which was Hied in the Second district court this morning, la a lengthy document and cm it is incorporated the contract which Spielberg says he entered on which the suit is baaed. The plaintiff avers that under this contract he was to be manager of the retail department of the store, the contract to last from January 1, INI, to January IS, INS, having the option of renewing it for another year. His salary was to be 1125.01 per month and In addition he was to receive $ 1 per cent on the gross sales and to have access to the books of the retail department. Speilberg was to deposit tfSO.M as a guarantee for the faithful performance of his part of the contract and the first 1500 commission was also to be held by the company as part of the bond, the entire amount to be returned to the plaintiff. His renewal of his contract, however, depended upon whether or not the sales for the year amounted to $10,000.
