Kelsey and Ogden City, defendants, and the amount eued for is $3,709.55 ts w HERE'S DETAILS: The action arise through the construction of the newer in district No. 9. The plaintiff and the defendant, Kelsey, entered into a contract under which the former should supply the latter with sewer pipe at & certain specified price, 75 per cent of the price to be paid when the city engineer made his monthly estimate on the work and the balance when the engineer had accepted the work as finally completed. The complaint alleges that between November 1, 1904, and January 9, 1905, material to the value of $3,709.55 had been supplied Kelsey and the city engineer had made hi estimates thereon; but it Is also averred that there is due Kelsey by Ogden City on that work performed $5,960.93, and the same has not been paid. The city engineer has not yet accepted the work as completed. so that the plaintiff does not sue for the 25 per cent deferred payment, but reserves the right to do so under the contract The lout is one of those, swagger affair, that back liberally long broad, graceful, any man. The Real Estate Men's asaoclation another meeting yesterday afternoon at about 5 o'clock in the office ol N. H. Ives where the principal subjects of discussion were the application for franchises made by B. Mahler and Simon Bamberger to operate electric railway systems in the city of Ogden. it waa the prevailing opinion among all of the members that the proposed roads should be encouraged, especially the one under contemplation by Mr. Mahler, basing their argument upon the fact that such a road would aid in building up this city and securing for it access to the markets or tue fertile and prosiierous valley on the north as well as provide many of the requi ite pertaining to the social line. The gentlemen believe that such a road should be aided and encouraged equal ly as strongly as a line like the Union Pacific or the Western Pacific. Mr. Nor do they underestimate Bamberger's road in the least, but, on the other hand, they believe that this road will benefit the farmers along the line and the residents of the smaller town to no small extent and that it held trans-continent- will Rusxio-Japane- se give them an opportunity to trade in this city. Above all they believe that Mr. Bambergers road will advertise Ogden as a scenic center and that tourists who chance to stop oft In this city will be given a splendid opportunity to visit the Ogden Canyon In a short siace of time and at a reasonable fare. Most of the members of the association will attend the next meeting of the city council to advance their views on the question and to urge the granting of both franchise.
