Klng, was convicted of murder for the killing of Col. Godfrew Prowse, was sentenced to death for the third time by District Judge Booth at Salt Lake today. King, whose appeal for a new trial waa recently granted by the supreme court, will probably be given his liberty. When Lynch held up the Sheep Ranch gambling house where It la known that he Prowse had an accomplice, and It waa supposed It waa King. Later developments have convinced nearly every one familiar with the caae that It muat have been some one else. Lynch was one of the convicts who got away In the recent jail break and was shot In the arm and nearly starved to death before he was several days later. Since then the appeal of both men has been heard In the supreme court, which handed down a decision granting King a new trial but affirming the ruling of the district court In Lynch's case. When Lynch waa brought before Judge Booth this morning he waa sentenced to be executed on January 8th. King, on motion of District Attorney Elchnor, waa discharged and la now a free man. In rummaging among old papers i Lynn gentleman has discovered the complete pattern of the Americas scythe, which was Invented two and s half centuries ago by Joseph Jencks, an Ironworker of Saugus, Massach setts. The Invention of the scythe, says the Boston Herald, Is referred to in Lewis and Newhalls "History of Lynn. This scythe took the place of the English "bushwhacker" scythe, mfc of a piece of thin steel, about eighteen Inches long and three Inches wide. Jencks more than doubled the length of the scythe, reduced Its width to one and Inches, and stiffened it by welding a square bar on the back.
