They want the subdivision fenced, and they want Allred to pay for it. In a recent city council meeting Mayor DeLore thurgood said he would draft a letter to residents asking them to allow a fence be built on their property to protect children from the ditch. If residents agree. Allred will be ordered to build the fence. If Allred does not comply, the city will build the fence and try to collect restitution. If residents refuse, Thurgood said at least the city has shown good faith to try to correct the problem. "Our attorney said we still have some liability for not putting the fence in. but the ditch isn't part of it." Mayor DeLore Thurgood said. Scott Holt said the ditch is the way it's supposed to be and he maintains it will not be moved. At one point residents asked that the ditch be covered at the shared expense of the residents, the ditch users and the West Branch Ditch Company, which prov ides the water. Kuck said he is not willing to put a lot of expense into the ditch. "It's the contractors responsibility. He knew that ditch was there before he ever built that subdivision," Kuck said.
