considered the government’s appeal of a landmark nuclear weapons decision linking open-ai- r testing to cancer cases downwind Janet Gordon has kept vigil She recalls the dozens of southwestern Utah neighbors once awed by the mushroom clouds rolling over the desert floor from the Nevada Test Site some 200 miles northwest who sickened and died And she remembers one death in particular that of her brother Kent Carroll in 1961 from pancreatic cancer she is convinced was caused by radioactive fallout “He suffered so incredibly I can’t tell you what an impact it had I felt really guilty that he was suffering as he was" Gordon said “That makes me more angry now than anything Those people at the test site sat there sanctimoniously and said it had nothing to do (with fallout) letting us think God was punishing us when God had nothing to do with it" said Gordon who is convinced she too will be claimed by cancer In 1980 Gordon helped found Citizens Call which lobbies on behalf of southern Utah northern Arizona and Nevada residents who lived in the path of fallout from the 1950s and early 1960s tests On Sept 14 1982 US District Judge Bruce Jenkins began hearing nine weeks of suit on testimony in a massive behalf of 1192 plaintiffs including cancer and leukemia victims and their families k On May 10 1984 following a trial and 17 months of deliberations Jenkins ruled that fallout had caused cancer in 10 of 24 representative claims and that the government had been negligent in the way it conducted the testing He awarded $26 million in damages to the nine of the 10 plaintiffs still alive The government appealed and oral arguments were heard by the US 10th Circuit Court of Appeals in Denver on Dec 9 1985 The case has been under advisement since “It’s kind of discouraging" said former US Interior Secretary Stewart Udall a Phoenix attorney representing fallout victims “This case goes back to 1951 and that means that a lot of the people involved are elderly We know some of them may be dying and that makes it difficult Udall noting the case is in its ninth year said he hoped for “some justice at the end of the line" for his clients “It makes you feel a little bit hard about ' your government They don’t seem to be able to do anything except take a very hard line" he said “People continue to die We had a call (recently) from our hospice organization Another young
