Gasoline pumps shall be set back not less than twenty (20) feet from any street line to which the pump island is vertical and fifteen (15) feet from any street line to which the pump island is parallel and not less than twelve (12) feet from any residential zone boundary line. If the pump island is set in an angle on the property, it shall be so located that the automobiles stopped for services will not extend over the property line. In no case shall the pump island be set back from a street righty line less than fifteen (15) feet. 7-- 3. con--structi- on - of-wa- CHAPTER 8 ESTABLISHMENT OF ZONES Declaration.1 In order lo accomplish the purposes of this ordinance as set forth in- - Chapter 1 hereof the city is' hereby divided into zones in accordance with a comprehensive plan of zoning. In the preparation of this ordinance, due and careful consideration was given, among other things, to the suitability of the land for particular uses, to existing and probable future conditions within the city, and to the character of each of the several'zones, with a view toward conserving the value of buildings and encouraging the most appropriate use of land throughout the city. 1. one-fami- -- 8-- Zones. 2. l" one-four- th Industrial Zone. Special Highway Service Zone. Location of Zones MAP. The location and boundaries of each of the zones are shown on a map Entitled ,Zone 'Map of Payson City, Utah, and all boundaries, notations, and other data shown thereon are hereby made a part of this ordanance to the same extent and effect ai if such data were fully described herein. . ' Location of Buildings and Structures. A. Side Rard. The minimum side yard for any dwelling or other main the distance from the grade to the building shall be one-hasquare of the building, except that the minimum side yard for any main building shall nofbe less than eight (8) feet, and the total width of the two required side yards shall not be less than twenty (20) feet. Accessory buildings which are located less than a distance of ten (IQ) feet in the rear of a main building shall have a side yard of not less than eight (8) feet. Accesory buildings which are located a distance greater than ten (10) feet in the rear of the main building shall have a side yard of not less than one (1) foot. On corner lots the side yard which faces on a street sKall hot be less than twenty (20) feet for both main and accessory buildings. No accessory building shall be located closer than fifteen (15) feet to any dwelling on an adjacent lot. B. Front Yard. S-- l. 8-- 3.- lf 1 Boundaries of Zones. Where uncertainty exists with respect to the boundaries of the various zones, the following rules shall apply: A. Where the indicated boundaries on the zone may are approximately street or alley lines, said streets or alleys shall be construed to be the zone boundaries. B. Where the indicated boundaries are approximately lot lines, said lot lines shall be construed to be the zone boundaries unless otherwise indicated. C. Where land has not been subdivided into lots and blocks, the zone boundaries shall be detedmined by use of the scale of measurement shown on the map. C.'' The minimum rear yard for dwellings and other main (25) feet, except that on corner buildings shall be twenty-fiv- e lots the minimum rear year for dwellings and other main buildings which have an attached garage or carport shall not be less than fifteen (15) feet. Accessory buildings shall be set back from the rear property line at least one (1) foot, except that on corner lots accessory buildings shall be set back at least eight (8) feet. Height of Buildings. The maximum height of any dweling shall be thirty (30) feet or 3 stories, whichever is higher, and the minimum height of and dwelling shall K eight (8) feet, or one story, in height, whichever is higher. Roofs above the square of the building, chimneys, flagpoles, television antennas, church towers, and sim ilar structures not used for human occupancy are excluded in determing height. Size of Buildings. The ground floor area of any dwelling or other building used for living purposes shall be at least seven hundred fifty (750) square feet of net living area, exclusive of open porches, attached garages, and breezeways. Special Provisions. For the purpose of determining front, side, and rear setback requirements a carport, garage, pergola, arbor or other building located within 10 feet of a dwelling shall be considered as a part of said dwelling. See also Supplementary Regulations to AH Zones. R-- 2 Residential Zone General Objectives and Characteristics of Zone. The R-- 2 Residential Zone has been established as a district in which the" primary use of the land is for dwelling purposes. The objectives in establishing the R-- 2 Zone are: 1. To encourage the construction of dwelling and the continued use of the land within the zone for dwelling purposes. 2. To prohibit commercial and industrial use of the land and to prohibit any other use which would substantially interfere with development or continuation of the use of the land for dwellings in the district. 3. To foster a wholesome social environment favorable to family life and the rearing of children. 4. To encourage the orderly and timely conversion of certain open land areas within the city into residential areas as the need occurs. While this zone is currently characterized by large lots or tracts of land interspersed with dwelling U barns, and corrals for the keeping of animals and fowls, it is intended that the open land uses within the district shall be converted into residential uses as the need occurs if that the barns U corrals will be removed as dwellings are constructed. In harmony with this intention, residential development which takes place within this zone in the future shall be some- 9. "Width Requirements. The minimum width of any building site for a dwelling shall hfe sixty (60) feet, measured at a distance twenty-fiv- e (25) feet back from the front lot line. The minimum width for any building site for buildings other than dwellings shall be at least more than the length of said building measured parallel to the front lot line. 2. 1 ly (30) of the'lot. Bulletin boards not exceeding eight (8) square feet in area appertaining to the sale or lease of property: also name plates fn connection with dwellings and home occupations not exceeding two (2) square feet in area, provided such signs are constructed ' and maintained in harmony with the residential character of the zone. 14. ' Fences, Walls, and hedges not exceeding seven (7) feet in "height. 15. Temporary buildings or yard for storage of construc tion material and equipment incidential and necessary to of houses, utilities or other community facilities, provided such temporary building or yard is located on the same tract of land on which the houses, utilities, or other community facilities are constructed. A permit therefor shall be issued only to the contractor or builder and shall be valid for not more than two (2) yfears, at the expiration of which time the said building or yard shall be removed from the premises and said use discon" ' 11 tinued. 16. Dwelling groups (planned) when first approved the by Planning Commission and the Board of Adjustment. Area Requirements. The minimum building site shall not be less than six thousand (6,000) square feet in area for each dwelling and one thousand (1,00) additional square feet for each additional dwelling unit. Both main and accessory buildings shall not cover more than thirty percent of the total area and sidewalk on the street, all curb cuts and driveways shall be made in accordance with these regulations. 6.. Where there is no existing curb and gutter or sidewalk, the applicant shall install a curb as directed by the Building 8-- The minimum setback for'main biddings shall be equal the distance from the grade to the square of the building but to owned by persons residing on the premises. 10. CHAPTER 9 REGULATIONS WITHIN ZONES Within each of the zones, the use of land and buildings for trade, industry, residence or other purposes, the location of buildings and structures, the percentage of lot that may be occupied, the size of yards, courts and other open spaces and the density of population are hereby regulated and restricted as set forth in this ordinance. R-- l RESIDENTIAL ZONE. General Objectives and Characteiibtics of Zone. The R-- l Residential Zone has been established as a district in which the primary use of the land is for dwelling purposes. The objectives in establishing the R-- l Residential Zone 9-- 1. are: t (1) To encourage the construction of dwellings and the continued use of the land within the Zone for dwelling purposes. (2) To prohibit commercial and industrial use of the land and to prohibit any other use which would substantially interfere with development or continuation of dwellings in the : ' district. r (3) To foster a wholesome social environment favorable to family life and the rearing of children. This 'zone is characterized by a residential environment' having a variety of residential buildings, a minimum of vehicular lawns, trees, shrubs, and other plantings, and ' traffic, well-kequiet residential conditions. Representative of the uses within this zone are one,- two, and dwellings, apartment houses, parks, playgrounds, schools, churches, and other community facilities. In order to accomplish the objectives and purposes of this ordinance and to Stabilize and promote the essential characteristics of" this zone, the following regulations shall apply in the R-l Residential Zone: Use Requirements. in the R-- l ResiThe following uses shall dential Zone: 1. Dwellings, apartment houses, boarding and rooming houses. 2. Churches, schools, libraries, and other public btiildings, provided nO open storage yard or repair shop shall be permitted. 3. Public parks, public recreation grounds,' but not in- -' eluding privately owned commercial amusement parks or fecrea- -' tion grounds. 4. Public and private hospitals and clinics for human care. 5. Office of a professional person when located in the same dwellihg in which said professional person resides. 6. Home occupations (see definition.) 7. Clubs and fraternal socities, except those the chief activities of which are services customarily carried on as a busi1 1 5 pt - three-famil- y 21 -- ness. 8. Agriculture, provided that no animals or fowls may be kept, except household pets which are maintained in accordance with the laws and ordinances of Payson City.
