guilty Monday January 31 23 am 911 dispatch receised reports of a semi rollover at the intersection of SR64 (Holden Main Street) and SR50 Trooper Tom Schneiler and Deputy Rhett Kimball responded to the scene as well as UHP commercial vehicle inspector Trooper Jim Hillin Eric Schneiter said that a black 1996 Peterbilt truck and trailer driven by Balch of Joseph UT rolled onto its side as it made the turn onto SR50 The crash spilled 48000 pounds of cottonseed onto the roadway as well as 30 gallons of diesel from the fuel tanks Crews spent hours removing the spill from the road and the truck sustained 520000 damage Balch was cited for speed too fast for conditions and log book violations He was uninjured in the crash 6:35 pm Robinette Tapoof 25 of SLC UT was arrested at mp 169 Southbound by Utah Highway Patrol Trooper Rod Elmer Tapoof was driving a silver 2000 Dodge Durango when she was stopped for speeding 84 mp 75 zone She could only produce an identification card and a license check showed suspended She was transported tojail and charged into East Millard Justice Court with Class C misdemeanor speeding and driving on revocation Her bail was set at $340 which she posted and was released - ednesday February 11:12 am Alan Hardy 38 Delta was arrested on a $190 warrant by Deputy Roger Young The warrant had been issued from the Wayne County Justice Court Hardy was able to post the cash bail and was released after being advised to contact the court to see if a future appearance was necessary or the bail would clear the charge at mp 138 w ith a 3:29 pm 91 dispatch received reports of a car on fire on disabled subject trapped inside Troopers Tom Schneiter and Mike Thomas responded as well as Fillmore Ambulance and Kanosh Fire Department A 1990 Chevy Blazer when the driven by 47 years old Monte Ellis of Laramie WY was southbound on ehicle began to have mechanical problems He stopped the vehicle on the side of the road and it caught on fire He quickly removed his granddaughter and his wife from the car she is confined to a wheel chair Other motorists stopped with fire extinguishers but were unable to stop the blaze The three watched from the road side as the vehicle burned and was totally destroyed before fire crews arrived The vehicle was a total loss but the occupants were uninjured Thursday February 3 :00 am Ted Kim Jackson 39 of Kanosh w as arrested by Deputies Clete Carter and RicLCaoer 91 dispatch had received report of a domestic disturbance at 310 W 200 N in Fillmore Clete Cater responded and met w ith the two intoxicated subjects that had been involved Deputy Bill Jackson was busy with a runaway juvenile that he located at the Budget Stop Texaco so Deputies Rick Carter and Steve O’Camb were called to respond from home Investigation at the scene showed that an altercation had occurred in which the female subject was injured Jackson was transported tojail where he was charged into Fillmore City Justice Court with Class B misd domestic assault He apHe was peared in front of Judge Hare later in the day and pled guilty to the charge released after the jail sentence was suspended He was put on court probation which will be violated if he commits any further law violations or consumes any alcohol He w as given a $3 70 fine w hich w ill be due in $50 a month installments This was Jackson’s 5 arrest since 1997 7:44 am Stephen Robert Miller 21 of Spanish Fork UT and Bradley Collin Miller 18 of Holden were ordered booked and released by the 4 District Court in Fillmore Both were cha’ ged by the Millard County Attorney’s Office on an official information with 3 degree felony aggravated assault Deputies Rhett Kimball and Devon Quamberg investigated the incident that occurred in Holden Canyon on July 18 1999 Both will make their next appearance on February 7 This booking was the 9 arrest in Millard County for Stephen who is currently on supervised probation and has served 401 days since he was certified as an adult when he was only 17 Bradley is currently awaiting sentencing on his felony convictions from a plea agreement in District Court last month Friday February 4“ 19 9:00 am Kyle Edwards 18 of 155 S Main St Fillmore UT was booked into jail to serve a 30 day contempt of court commitment from the 4 District Juvenile Court He is on probation from that court for a variety of convictions on eight juvenile arrests On Wednesday February 2 Edwards appeared in front of Juvenile court Judge Leslie Brown on an order to show cause hearing regarding violating his probation with multiple arrests since he became an adult Brown sent him tojail for the 30 days and ordered his probation terminated after the jail sentence is complete He was released that day and ordered to turn him self in tojail by 9 am on Friday the 4 (Today) Edwards must have used the day and a half before he checked in to plan how he could smuggle contraband into the jail At 3:00 pm on February 5 Deputy Sam Draper and Lt Forrest Roper recovered marijuana and contraband from Edwards who had concealed them inside a body cavity by swallowing a balloon containing the items Draper charged Edwards with 3 degree felony possession of a controlled substance inside a correctional facility and Class B misd possession of a controlled substance 5 by 3 :2 pm Brian Ward Twitchell 22 of Shelley ID w as arrested at mp 56 on Trooper Deut Shields Twitchell was driving a black 1994 Jeep pickun truck when he was stopped over 80 mph in a 75 zone Shields could smell marijuana in the vehicle and asked the driver to perform fie'd sobriety tests Drug use was suspected and the subject was arrest for driving while under the influence of drugs A search of the vehicle incident to arrest uncovered marijuana a pipe and rolling papers Tw itchell was transported tojail and charged it to EMJC with Class B misd DUI Drugs possession of drug paraphernalia and possession of marijuana Bail was set at $1675 by Judge Ron Hare which he posted and was released Saturday February 5“ 4:30pm William Bradford Quinn 35 ofSLCUT was arrested at mp 173 northbound Quinn was stopped for speeding 84 mph and Thomas by Trooper Mike Thomas could smell burned marijuana in the vehicle A vehicle search uncovered scales and a small amount of marijuana Quinn was transported tojail and charged into EMJC with Class B misd possession of marijuana possession of paraphernalia and Class C misd speeding Bail was set at $965 Sunday February 6 2:15 pm Caleb Emory Kirkland 23 of Laramie WY was arrested at mp 162 northbound by Trooper Gordon Mortenscn Kirkland was driving a white 1989 Ford Mustang when he was stopped for excessive window tint Mortenscn was suspicious of the vehicle and requested a search which the driver consented to obstructed windows Bail was set at $965 which he posted and was released 6:40 pm Sidney Montrel Kennedy 32 of Kearns UT was arrested at mp 177 southbound by Reserve Deputy Dale Josse and Trooper Rod Elmer Josse stopped the green 1999 Hyandai Tituron for speeding 13 mph in a 75 zone A records check showed that Kennedy had an active warrant from West Valley City Police Department where he had failed to pay a speeding ticket Officers searched the vehicle incident to arrest and located drug paraphernalia and an open container of alcohol A passenger 20 year Mauu Taafuli of California was cited for Class B misd open container of alcohol in a vehicle Kennedy was transported tojail where he was charged into EMJC with Class B misd possession of drug paraphernalia and Class C misd speeding plan as presented by Warren Peterson attorney Chairman Robin Smith said it was a good spot for a dairy because there are already dairies in the area Carl Lyman board members said he was concerned with drainage if there was a large rainstorm County Commissioner Cox said NRCS will approve the design and the ground waters and irrigation waters will be protected by the NRSC permit Lyman said there must be a setback from the lagoon to the property line If more than 700 animals are located on the premises the setback increases to 100 feet The conditional use permit was unanimously approved v ith the 100 foot setbacks a condition Charles T Bell conditional use perenit Charles Bell’s son Thomas Bell was present to answer questions regarding the application He has researched several states and found this site to be the one of choice New maps and a plot plan of the rom the dairy' area was given to the board there will be 150 feet from the center of the corrals to the south and north The north side of the lagoon was moved to the corrals to work with the prevailing w inds Chairman Robin Smith asked for comments from those present Don Smith said he is probably the closest resident with the dairy being about 1500 feet from his home Dairies are fine and there are several uses for them including hay sales However he doesn’t think a dairy should be placed near homes Since it will stroy the value of his residence as well as many others Hal Terry said he lived across the street and asked about pest control and if sandy soil would not be better for dairies He is opposed to the dairy but is not opposed to dairies in the area Elden Shurtz lives about 14 mile from this operation and is concerned about their water supply His wells are 90 feet deep and is approximately 14 mile from the proposed lagoon John Nye dairyman said the lagoons are designed by NRCS The test the soil and clay is probably better suited for a lagoon than sandy soil since they are usually sealed with clay or bentonite The sediment from the lagoon is allowed to move approximately two inches in 100 years which does not amount to much A lagoon is not a threat to the water supply NRCS decides what they need then doubles it and adds 50 percent just to be sure Howard Clayton said he has made goons all over the estate The compaction is 90 percent and NRCS checks them closely to be sure infiltration is not happening After 20 years in the mining business Paul Hardy said he has not seen a tails pond yet that did not leak However his problem is the condition of the roads in the area of the proposed dairy theft vandalism and auto burglary It was one of the busiest non summer weeks of the year Speeding tickets on MCSO deputies issued 106 tickets on spxial speed enforcement shifts this week The average speed was the highest one we’ve had since we started keeping the speed statistics in June of 1999 This weeks average speed was a real fast 937 of mph and there were II ticket IOOmph Sgt Scott CoiTy
