had been a confidential informant for Millard County SJ8 he Callahan case was since eb his last case in Millard County Kimball said the Millard County Sheriffs Office paid Pierce $100 per buy and all of his lis ing expenses he sheriffs office also required him to get another job during his stay in t illmore He washired at Paradise Management Pierce signed a contract ith the Millard Sheriffs Office before he started County working as an informant Kimball said the contract included an understanding of trapment and how to avoid it He also said confidential informants are not lowed to have sex with anyone under vestigation and that they are not allowed to break the law in order to complete an investigation Pierce testified he did not hav e sex with Callahan or any one else he was investigating Pierce testified he was Callahan's friend nothing more He said he spent the night at her house a couple of times He said sometimes they drank alcoholic erages together He admitted that he told Callahan his wife was sick and dy ing Kimball testified that Sheriff Fd Phillips believes use of confidential informants is the only way to effectively tight drug distribution in the county Kimball said he concurs ith Phillips assessment Pierce was reportedly not hired specifically to investigate Callahan Before beginning the case against Callahan Kimball said he told his superiors he anted to use Pierce to do a rev erse buy on her Pierce's objectives were to approach Callahan advise her he had a brother who was "tweaking" and that he needed her help to sell marijuana for him Kimball told Pierce to tell Callahan he didn't want to keep the marijuana at his house because his wife had been heav ily into drugs and he could not trust her Pierce ith Callahan at her home about Oct met and gave her the story Kimball told him to tell She and her three children were home during the visit Pierce said they talked about marijuana prices and that he lbs of martold her he w ould give her He testified that they agreed that ijuana Callahan would get 20° of the profits from the sales and he would get 80 Pierce met w ith Callahan the evening of Oct 4 at her house Kimball said Scott Bninson was isiting w hen Pierce arriv ed minutes Pierce was there for Kimball said the body bug Pierce w as ing did not work that night because the batteries were dead Pierce said he did not do anything to make the body bug not work Scott Brunson Callahan's neighbor and friend testified he spent the weekend fore the controlled buy with Callahan in Mesquite Nevada He was w ith her on the night of Oct 4 when Pierce visited her house Brunson said he was on the couch with Callahan's children Pierce reportedly opened the door and came in w ithout knocking He immediately went downstairs with Callahan she did not want to do hen she said no he put presso and that sure on her Callahan then said Pierce told her what Kimball had told him to say his about brother and his w ifc using drugs She said even though she didn't want to take the drugs from Pierce she was confused because she liked Pierce a lot On Oct 5 Kimball Phillips and Sgt Jeff Whatcott met with Pierce and gave him a 6 lb brick of marijuana to sell to Callahan Pierce testified Kimball put the brick into the trunk of his car Kimball testified that Pierce was told to hand the brick to Callahan and then make an excuse to leav e and go home Pierce ore a body bug listening device during the alleged transaction which took place at Callahan's house Kimball Phillips and Whatcott listened and watched as the leged transaction as made hen he arrived Pierce knocked on Callahan's door and took her to his car He testified he opened the trunk and told her "Well theie it is" She allegedly picked it up took it into her house and he left Pierce testified that Callahan agreed to sell marijuana for him and that she did not hesitate Callahan said she was asleep when Pierce arrived She said she suggested putting the marijuana in a storage shed cause she didn't want drugs inside her house Pierce left quickly after handing the marijuana brick to Callahan She took it into her house She said Kimball arrived minutes later After the alleged sale Kimball made contact w ith Callahan and arrested her He said he asked her for the marijuana and told her there were 6 lbs She allegedly "There was that much?" responded Kimball said he read Callahan her Miranda Rights at the front door Callahan testified Pierce intimidated her and that she felt pressured to take the drugs from him Anderson asked her why she didn't go to a neighbor's house to call the sheriffs office to report the incident as soon as Pierce left "He said if anything happened to the drugs it would be my ass" Callahan tified "I felt threatened " Before the controlled buy Kimball said he and Anderson discussed ways to forfeit Callahan 's house after the buy Pierce testified that he and Kimball also discussed forfeiture of the house before the alleged drug buy Callahan's testified nephew that he and his mother Carmen al latum alked in on Corrina Callahan and Pierce while they were in bed together He said Pierce paid him S5 to leave the room He testified that allahan and Pierce were under the covers and he didn't think they were dressed armen Callahan later tified this incident occurred in early September of IsWX She said she witnessed them hav ing sex lara Sperry of llolden said she went on a trip with Callahan to Salt ake City and ogan in Callahan's big rig Callahan a truck driver Sperry said Pierce is sisted on going with them He told them his wife was dying and he had Callahan take him To a hospital in ogan to visit her During the trip Sperry testified she saw Pierce touch Callahan in sexual way s and that she heard him tell her he wanted to have sex with her "What he did was real!) wrong" Sperry said testified that Pierce was very Sperry sexual around a lot of people Callahan testified she considered Pierce to be her boy friend She testified that sex with him at least four times about the trip Sperry 's testimony to ogan Callahan said Pierce helped her w ith her kids and helped around her said Pierce made her believ e he wanted a relationship During his closing argument Slav ens read case law in similar cases He said there is reasonable doubt that Callahan's acceptance of the marijuana was voluntary In his closing statement Anderson said sex in and of itself does not mean there was entrapment He said the extreme emotional relationship that rises to the level of trapment does not exist here Hansen look the matter under adv He gav e Anderson and Slav ens the opportunity to submit written arguments He is expected to render a decision sometime within the next 30 days If he rules Callahan was entrapped the
