new ordinances were passed Monday night at the regular meeting of the Delta City Council Among new ordinances placed on the city law books is an amendment to the business license ordinance redefining “licensed prem- Phelpt of Sl George was allegedly traveling at 85 miles per hour Shields said he slopped the vehicle for speeding but arrested Hirschi after she allegedly failed a field sobriety test H irschi was charged with DUI speeding and having an open container of alcohol inside the passenger compartment of a vehicle A passenger in the vehicle 20 year old Sara Fisher of West Valley City was also arrested and charged with unlawful consumption of alcohol Shields said both suspects were charged with consuming alcohol because they were under The Utah Highway Patrol has been busy this month with several accidents and drug busts According to Trooper Gordon Mortcnsen of the Highway Patrol 23 year old Sonti Burnett of Salt Lake City was arrested August 13 on drug charges after a traffic stop Mortcnsen said Burnett was driving a 994 Nissan AIlimaonI-1two miles south of Fillmore about 7:00 pm The vehicle was stopped after Mortensen received a report it had been weaving in and out of traffic When the vehicle stopped Mortensen said he could tell Burnett was impaired Burnett was charged with a class B misdemeanor count of DUI No alcohol was found inside the vehicle but Mortensen said he found prescription drugs which had been purchased in Mexico Mortensen said Burnett did not have a prescription for the drugs Drugs found included Valium Soma and Fioricct which are controlled substances Burnett also allegedly tried to take Valium into the jail after his arrest The drug was found and confiscated In Millard County Fourth Circuit Court last Thursday Judge Anthony Schofield set a waiver hearing for September? and allowed Burnett to remain free on his own recognizance Charges read in court last week included the DUI count two class B misdemeanor counts of unlawful possession of a controlled substance a class A misdemeanor count of unlawful possession of a controlled substance in a correctional facility and a third degree felony count of taking contraband into a correctional facility 21 A one vehicle rollover was reported on August 19 on US Highways 650 just over four miles east of the Utah Nevada stateline Shields said 30 year old Patrick A Hiblcr of Vail Colorado was allegedly driving a 1989 GMC Jimmy cast traveling at approximately 75 miles pier hour when he apparently fell asleep The vehicle ran off the right side of the highway Hiblcr overcorrected and the vehicle ran off the left side of the road and rolled three times H iblcr and a passenger 25 year old Chris Reeder of Vail sustained minor injuries but refused treatment Shields reported a carcow accident on August 18 on US Highways 650 The accident occurred about 6:00 am 25 miles west of Delta Shields said 20 year old Irvin L Sweeting of Fairfield California was driving a 1994 Mazda eastbound enroute to Golden Colorado when a cow crossed the highway in front of the vehicle in an open range area Sweeting was not injured but the cow was killed No citations were issued Trooper Dean amended for property owned by Andy Thompson Thompson is building a subdivision in an area in back of Delta Middle School The subdivision will include single family dwellings Waddingham gave a history of the ordinance The property was originally planned for development of different types of d wellings which required more water than the subdivision planned by Thompson The ordinance governing the area had to be amended to allow for a lower water requirement An ordinance creating a no parking zone around Delta North Elementary School was adopted Parking on certain streets around the school will be prohibited Monday through Friday while school is in session An area on 50 East from 00 North to 200 North was designated a no parking zone all of the time The council approved a request for financial aid to the ME Bird Center The center is having trouble paying its water bill so the council agreed to pay the center's basic water bill and sewer bill The center will be responsible to pay for any overages on the water bill The city collects landfill fees for the county on its w ater bills The council decided to have the center contact the county for assistance with the landfill bill If the county agrees to eliminate landfill charges for the center the city will stopcollec ling the fees The landfill matter will be up to the Millard County Commission Discussion about Delta City’s Centennial Project was tabled for further consideration at a later meeting The city is considering a flag display A bid was approved for siding work to be done on the Delta Airport Hanger The city has liquor in a separate room The action was necessitated by a request for a class B Beer License from Mike and Natalie owners of Plaza Lanes The Holda-ays want to set up a tavern in a separate room build a warehouse in the area near the Delta Technical Center Approval was given as long as Della City maintains 60 feet of right of way The approval was also contingent upon the school district’s agreement to install asidcwalkinthe construction area at the street Delta City Attorney Richard Waddingham was asked to draw up an ordinance to authorize vacation of a portion of the right of way on the street In other action the final plat of the Myers Subdivision was approved KirU and Lisa Myers provided the council with maps of the subdivision The council agreed to approve the plat as long as Monday's regular commission meeting Dcarden said he and Millard County Tourism Director Glen Swalberg attended last Tuesday’s Six County meeting in Richfield Panoram aland was discussed According to Dearden there is a proposal to resurrect the program Under the proposal Millard County would pay $1000 toward Panoram aland Money would come out of the Millard County Tourism’s Transient Room Tax account Each of the six counties involved in the AOG would put brochures together to promote their areas Dearden said he thinks the state should set up a new tourism system He told the other commissioners that it seems the state is relying on local governments to implement programs which should be taken care of by the state He said he is concerned about the AOG layer of government operating in Utah In other action the commission approved the issuance of a Special Use Permit with USDAForest Service The permit is for a ten year no fee lease for television translators in the county Approval of an application for a - r Millard Millard County Commission 'if n 1 r C second COPS FAST Grant for the Millard County Sheriff s Office was ratified The commission approved the application at the August 21 regular commission meeting During the commission reports Commissioner John Henrie said the 'Westside Recreation Department has been asked to fund construction of a storage unit at Sunset View Golf Course in Delta The unit will cost approximately $13000 to build The maintenance department requested the funding If the commission approves the request money will come from the Capital Improvement Fund The item will be placed on the agenda of the September commission meeting Dearden reported that he enjoyed the Demolition Old Capital Cruisers’ Derby last Saturday in Fillmore “I thought it was really good" Dearden said Lana Moon said Commissioner Wynn Walker proposed a study of the Sevier River Moon said the proposed project would include putting geographic information about the river into a computer Walker reportedly said such a project might have prevented flooding in West Millard County in the late 1980’s Moon told the commission that Walker needs a $49000 grant for the project She said water companies support the study plan Dcarden said he doesn't think die county should fund the project at all He said he believes users along the river should help pay for the project Moon said she told Walker she would get back to him after she finds out if funding is available Dearden said he was contacted by the BLM about fencing on 4500 South between Lone Tree Road and Deseret He said some of the land is owned by the BLM and some is privately owned Dearden said the BLM wants the county to pay to have the private property fenced at the highway The commission said the only time the county replaces fences is if the county damages them The commission said no to the request Moon reported that she would attend a Congressional meeting this week on the RJS 2477 issue Dearden said the Federal Government will put the issue on hold for a year before any action is taken the Auditor's During Agenda County Auditor John Hansen reported about complaints concerning differences in charges between use of the Delta fairgrounds arena and the Fillmore Fairgrounds arena Use of the Delta arena is reportedly more expensive Moon said she thought uniform fees had already been seL The commission said it will investigate reports of different fees and make sure uniform rates for both facilities are enforced County employee Richard told the commission that he is going into business with another person He said the business has nothing to do with Millard County Beckstrand is legally required to disclose his business venture to the commission He said he will do computer work for different cities and towns Gwen Hunter and Sylvia Huntsman for the Millard County Centennial Committee showed the commission a design for an official Millard County Flag The flag will measure three by five feet Colors will be red white blue yellow and black The design will show a map of the county underneath lettering saying “MILLARD COUNTY" The commission approved the design Star Flags in Sl George will make 50 Hags It will take about six weeks for the flags to be completed and shipped to Millard County The total cost of the flags is $2660 The flags will be purchased from the Centennial Committee's budget Millard County School District SuDr Kenneth Topham perintendent asked the commission to waive ambulance fees for school events The commission explained that it would not be able to do so but suggested several alternatives Dearden told Topham he is not opposed to the school district approaching the ambulance operators individually to see if they would be available for on a volunteer basis Sheriff Ed Phillips said he did not object to the idea Phillips suggested asking an EMTto be at the game with a jump kiL An ambulance would not be at the game but would be called to the scene if needed If there were an injury Phillips said an EMT with a jump kit could assess the injury and call for an ambulance if one is needed Phillips said that an ambulance is only
