various projects MILLARD Dafoe attends Millard County Relief for charitable donors Taxpayers who made contributions of S250 or more to charities during 1994 are being relieved from the statutory requirement that before they file their l‘4 returns they obtain adequate written acknowledgments from the charities The IRS is providing this relief because of difficulties taxpayers are reporting in obtaining these acknowledgments In a notice released today the IRS said that taxpayers can still claim deductions for charitable contributions of S250 or more on their 1994 returns if they make a good faith effort on or before Oct 16 1995 to obtain the quired written acknowledgment form the charity One example of a good faith effort would be sending a letter to the c harity requesting the acknowledgment Congress changed the law in 1993 to require taxpayers making charitable contributions of S250 or more to obtain from the written acknowledgments charities for these contributions This law requires that an acknowledgement be obtained by the earlier of the filing of the taxpayer’s return or the due date of the return including extensions It also requires that the acknowledgement state whether the er received anything in return for the contribution Taxpayers who do not itemize cannot claim charitable contribution deductions and are therefore not affected by tins announcement Taxpayers who have already filed their 1994 returns and wish to take advantage of this limited relief should file an amended return using Form 1040X Taxpayers are reminded they must comply with all of the requirements of the tax law in order to be allowed a charitable contribution deduction The law allows the taxpayer to take a deduction only to the extent that the taxpayer intended to and did make a contribution in excess of the fair market value of anything received in return The IRS said it will sixrn issue additional guidance in the form of proposed regulations on substantiation of charitable contributions Commissionmayors meeting Ry Derin Phelps Delta Mayor Don Dafoe was one of many Millard County mayors who tended a meeting with the Millard County Commission last Thursday evening Dafoe reported on the meeting at Monday night’s regular Della City Council meeting Dafoe said the commission proposed a reduction in revenue sharing He said that under the proposal Millard County will reduce revenue sharing funds by 25 percent each year with a total elimination of revenue sharing funds after four years Dafoe said Delta will receive the full amount of revenue sharing funds this year Mayors in attendance reportedly tried to gel the commission to reconsider the issue each year instead of ending revenue sharing after four years Dafoe said the commission made its decision based on concerns about IPP tax protests and tax protests filed by several utilities and airlines The commissioners said the county is not generating enough income through properly taxes and has had to cut its budget At the Millard County Commission Meeting on Monday Millard County Treasurer Mary Day presented the commissioners with property lax refund checks for Cilicns Telephone and Morris Air Service The Citizens check was for 1994 in the amount The Morris Air Service of S6727174 refund check was for 1993 property taxes in the amount of S5068809 New EPA requirements at the Millard County Landfill in Delta were discussed Landfill operators must now coverthccontenlsof the landfill withsix inches of fill dirt each night before the facility closes Mandatory garbage collection in each county municipality and concentrated area was also discussed Dafoe said he felt that everyone who attended the meeting was in support of mandatory trash pick ups Other items discussed at the mayors meeting included a planned trip to Jerome Idaho to explore the dairy recruitment issue and the Millard County Bookmobile A meeting will be held in the near future to discuss the future of the Bookmobile The next meeting between the Millard County Commission and county mayors will be at 5:30 pm on July 17 In other action Monday night the city council approved Delta City’s participation in the Drug Free School Zone program Millard County Substance Abuse Prevention Specialist Margaret Pruitt told the city council that all Millard County school principals decided to support the program at the beginning of this school year She also said the Millard County Sheriff’s Office and DARE Officers have been very supportive of her efforts Delta City Councilman Gayle Bunker said he has seen a real problem with smoking on the west side of Della High School Officials of the Della Technical Center have also reported smoking and drinking around the perimeter of the campus Dafoe asked Pruitt to place two Drug Free Zone signs in Delta City Park and one sign at Delta Neighborhood Park Drug Free School Zone signs will also be placed at Della schools Pruitt said the signs were received free from the National Guard in Fillmore She said she received four signs per school plus six signs for other drug free zones Fillmore City and Kanosh have also asked for placement of signs in their communities A request by LeAnne Massa to relocate the State Liquor Store was tabled until the April 24 Delta City Council Meeting Massa was not at the meeting and the city council did not know where she w ants to move the store An increase in the bill to DCH Construction for woik on the Delta Cemetery Bridge was approved The company made some unexpected changes in height on the barriers of the bridge The new total price tag for the project is S3360090 Millard County will pickup half of the price in the joint project The city council also approved payment of a bill to Sunrise Engineering for 52000 for inspection and testing on the site COUMTY FAIR Hot Diggity Dog by Rita Robinson Well hello again Can you believe it's that time of the year? Another year of reporting to you the latest events on the Millard County T air Thursday April 6 director of the fair Cherie Morris held a luncheon board meeting with several items on the agenda The first of was to pay tribute to a few board members that are retiring and to welcome aboard their replacements Leaving us are Mr and Mrs Mitchell and Norma Adams from Gardening and Mrs Faye Howell Mrs Stella Hawley and Mrs Louise Lovell from Foods Presenting plaques and tributes to them was Lawanna Peterson She thanked each of them personally for the many years of service and dedication to the fair Mitchell and Norma from Foods always represented the department with efficiency always appealing to the eye and with more entries every year You could always count on them for tips on how to improve your garden w ith their knowledge in that area Faye Howell Stella Hawley and Louise Lovell will be greatly missed not only for their skills their displays and their combined judging int he Food department but also from their bright smiles and hugs to the pure enjoyment they brought to the fair These ladies really loved their job association with the fair It’s like one big happy family All will be greatly missed So we publicly say thank you to these good folks but not goodbye because we’ll be seeing them from time to time lending a hand Cherie then proceeded to introduce the new sentenced in a Fillmore area drug case on June 7 in Millard County Fourth District Court Judge Anthony Schofield set the sentencing date last Wednesday after he ordered Petersen to undergo a 60 day diagnostic evaluation with the Utah Department of Corrections Chief Deputy Millard County Attorney Dexter Anderson said thediagnostic evaluation is more intense than a pre sentence report which is normally prepared by the Department of Adult Probation and Parole (AP&P) Petersen pleaded guilty on February 22 to possession of cocaine with intent to distribute He also pleaded guilty to possession of meth amphetamine with intent to distribute Both counts were second degree felonies Several charges against Petersen were dismissed in a plea agreement including possession of drug paraphernalia distribution andor of for the distribution arranging methamphetamine in a public park He near was arrested last December on Fillmore In other District Court action last Wednesday Thomas P Rogers pleaded guilty to a third degree felony count of evading a police officer and a class B misdemeanor charge of retail theft Three other charges were dismissed Rogers had also been charged with driving under the influence of alcohol possession of a stolen vehicle and driving without a driver’s license He was rested March after being stopped on in Fillmore Schofield ordered a pre sentence report and scheduled sentencing for May 3 Melvin E Dyer was taken into custody after allegedly failing to cooperate with AP&P in an attempt to complete a pre sentence report regarding sentencing on convictions of check forgery and theft by deception Dyer was on the court calendar for sentencing last Wednesday but Schofield postponed sentencing until May 17 to allow time for completion of the report Dyer was taken into custody and ordered to main in the Millard County Jail until he completes his obligation regarding the report Jerry T Wilkins pleaded guilty to a third degree felony count of attempted possession of a stolen vch icle Anderson said Wilkins was arrested on March 5 after the Millard County Sheriff’s Office determined he was in possession of a 985 Blazer stolen from Murray Utah As part of a plea agreement the charge was reduced from a second degree felony count of possession of a stolen vehicle Wilkins is reportedly on probation in another case Schofield said a probation violation may have to be dealt with at a later date Schofield said he would allow Wilkins to try to enter a drug treatment program He suspended sentencing until Wilkins successfully completes an patient drug treatment program In Fourth Circuit Court last Wednesday Gregory A Creek asked Schofield to review his sentence on a third degree felony conviction of possession of cocaine He was sentenced to 36 months of probation last November 4 and ordered to serve nine months in the Millard County Jail Creek has already completed five months of the jail sentence Creek’s attorney Craig M Bainum told Schofield that Creek is doing well and has completed a lot of community Bainum said the service work review request was made because Creek needs surgery on his ankle and plans to get married He said Creek wants to be released early so he can return to work in Montana and prepare financially for his upcoming marriage Schofield said he was concerned because the AP&P pre sentence report recommended a one year jail term Schofield said he already gave Creek a shorter sentence than the AP&P recommendation He ordered Creek to meet with AP&P and set the matter for further hearing to review the updated AP&P report on May 3 year old April Vcmon of Fillmore was arraigned on a third degree felony count of possession of stolen property and a third degree felony charge of theft of services Vernon was allegedly found in possession of a chain saw reported stolen from a Kanosh residence She is also accused of stealing 5640 worth of rental services from the Starglo Motel in Della from March 6 through April 2 of this year She was originally arrested in Fillmore on February 24 Vcmon claims she was released on her own recognizance but was on the same charge last Tuesday April 4 on a warrant Schofield released Vcmon again on her own recognizance He set a waiver hearing on both charges for April 20 Vernon said she wants to talk to the motel owners and try to work out the situation directly with them Schofield told Vernon she could talk to the motel owners as long as she does not harass them She said she would not harass the owners There was one case in Fourth District Court on Monday April 3 Raymond Young changed his pica from innocent to guilty of third degree felony theft and second degree felony forgery He was arrested in connection with incidents last fall at Duane’s Foodtown in Fillmore Delta area cattle case to be heard this summer A preliminary hearing against two Delta men and a Sandy man will be held in June or July in Millard County Fourth Circuit Court Douglas Turner and Dale Turner of Delta along with Jeff Palmer of Sandy agreed last Thursday to appear together for a joint preliminary hearing The two Turners are each charged with two second degree felony counts of theft by deception and a second degree felony count of theft Palmer is charged with ten second degree felony counts of theft The case is still under investigation by the Millard County Sheriff’s Office and the State Attorney General’s Office The case involves cattle allegedly placed on a Delta area fccdlol Alleged thefts occurred between January 20 1994 and April 30 1994 In other Circuit Court action last Thursday Judge Anthony Schofield set a waiver hearing for May 3 in a second degree felony child abuse case against Danny R Sturgis Sturgis was charged after an alleged incident last month A waiver hearing was set for May 3 for Jacob W Myers who is charged with a third degree felony count and a class B misdemeanor count of possession of stolen property Myers was arrested last month after allegedly stealing tools from Delta Valley Farms Myers was also allegedly in possession of a speaker box reported stolen from Sahara Motors in Delta Charlie A Taylor appeared to face several drug charges Taylor is charged with a third degree felony count of possession of marijuana with intent to distribute third degree felony possession of methamphetamine possession of drug paraphernalia giving false information to a peace officer and driving without a driver’s license He was rested on April 5 on in Fillmore Schofield set a waiver hearing for May 3 Bail was set at S2000 year old Lionel Junior Key of Delta pleaded innocent to supplying alcohol to minors Key was cited but not arrested after an alleged incident on March 20 Key told Schofield that he did not give alcohol to a minor but a minor gave alcohol to him w hilc he w as at a party A pre trial conference was scheduled for Apnl 20 Key was released on his own recognizance An appeal of a Delta Justice Court case against Jerry T Wilkins w as continued last Thursday No new court date was set Wilkins was convicted of theft by receiving stolen property and driving on a suspended driver's license He said he is not appealing the conviction He is appealing the sentence Wilkins was fined SI 850 which w as suspended for a 180 day jail sentence pending the completion of an Odessy House treatment program Edward D Clark and Raymond O Thomas were sentenced for their parts in a livestock theft case Clark pleaded guilty to a class A misdemeanor charge of attempted theft of livestock on Febru ary 23 Thomas pleaded guilty on the same date to a class A misdemeanor charge of aiding and abetting attempted theft of livestock Clark was sentenced to one year in the Millard County Jail Schofield suspended the sentence and placed Clark on 24 months of supervised probation He also ordered Clark to serve four days in the Millard County Jail Clark was ordered to pay 5100 in restitution and a 5300 fine or 60 hours of community service work to be completed in the next six months Thomas was sentenced to one year in jail which was suspended for 24 months of supervised probation Thomas was also ordered to serve four days in jail within 60 days and fined 5300 Thomas was also given the option to serve 60 hours of community service work in lieu of the fine as long as it is served within 60 days He was also ordered to pay a 5255 surcharge and 5100 in restitution Schofield also ordered Thomas to submit to mental health and substance abuse treatment A preliminary hearing was set for May 3 against Thomas W Stroud Stroud is charged with a third degree felony count of DUI after three previous convictions and a class B misdemeanor count of driving on a revoked driver’s license In Fourth District Court the results from a competency evaluation in a case against Rodney L Evans showed that he is competent to stand trail Evans is charged with a class B misdemeanor count of assault and a class A misdemeanor count of gross lewdness The charges arc the result of an alleged incident involving Evans’ teenage daughter Jeffery Glcavc was appointed serve as public defender in the case A pre trial conference was scheduled for April 20 Lorcna C New was also found to be competent to stand trail in a drug case against her New pleaded guilty to third degree felony possession of Schofield ordered a 60 day evaluation with the Department of Corrections before sentencing New faces similar charges in Washington County where she pleaded no contest She was arrested in Millard County last November 5 in Fillmore after she was found in possession of methamphetamine New will not be sentenced in Millard County until after she completes the Department of Corrections evaluation and is sentenced in Washington County She could face up o five years in prison a fine of 55000 or both A warrant for the arrest of Charles G Mason was issued after Mason failed to appear for a preliminary hearing in Fourth Circuit Court to face a second degree felony charge of burglary of a dwelling Other charges include second degree felony theft of a firearm third degree felony theft and a class B misdemeanor theft charge Mason is also charged in another case with third degree felony theft |
