Show Perjury Trial continued from front Fourth Circuit Court Report The following actions took place in Fourth Circuit Court Fillmore Court House Fillmore Utah on Friday October 15th 1993 Judge Joseph I presided Jeny Wallace Kauffman aka Jack Whitmore did not appear for a First Appearance on charges of contracting without a license a class A misdemeanor Slate advised Court that defendant has outstanding warrants also out of Daggett County and is in Missouri at the present time Matter was stricken from the calendar Cory B Hancock appeared for Arraignment and Entry of Plea on charges of Contributing to the delinquency of a minor a class B misdemeanor Mr Hancock entered a guilty plea to allowing juveniles to hunt morning doves from the back of a truck he was driving Judge sentenced Mr Hancock to 90 days in the Millard County jail and to pay a fine of $500 The Court then stayed all but $ 5 0 of the fine and placed defendant on 2 months unsupervised probation — Matt L Giles appeared for Arraignment and Entry of Plea for charges of 1) DUI with injury accident a class A misdemeanor 2) Driving on revocation a class B misdemeanor 3) Improper lane travel a class C misdemeanor and 4) No seat belt an infraction Defendant's attorney had called the Judge and asked that the case be referred to Utah County Dexter Anderson objected saying it was a Millard County case and should stay here Court granted defendant's motion to continue until October 22nd - Douglas Todd Nielsen did not appear for Entry of Plea to charges of ) Supplying alcohol to a minor a class A misdemeanor and 2) Public intoxication A $475 cash only bench warrant was issued for Failure to Appear David Crutchfield appeared for Sentencing on charges of Attempted theft of services a class A misdemeanor Mr Crutchfield had previously been sentenced and Court had reviewed the report from Adult Probation and Parole Dependant was placed on 18 months probation with AP&P term and fine were suspended all but for $500 Court reserved the question of restitution for the phone bill to 900 numbers Michelle J Bond appeared for Sentencing on charges of Retail theft a Defendant enclass B misdemeanor tered a plea of guilty and Court reviewed her criminal history of two past misdemeanor theft charges a felony drug charge in 1993 and her current supervision by AP&P Court sentenced defendant to spend 48 consecutive hours in the Millard County jail and will accept 80 hours of community service in lieu of a $200 fine Defendant was placed on 12 with months supervised probation AP&P Adam David Lee appeared for Sentencing on charges of 1) Joyriding (Unlawful control of a motor vehicle) a class A misdemeanor 2) Driving on a class B misdemeanor revocation Court placed defendant on 12 months unsupervised probation ordered defendant to serve 40 hours of community service in lieu of a $200 fine Defendant was ordered to report to Alternative Community Service Program in Salt Lake City - Nicole Huntsman appeared but was not heard for her Order to Show Cause Hearing Matter was continued to October 22nd Kevin Bradshaw did not appear for his Proceedings on charges of Vehicle burglary a class A misdemeanor and 2) Theft a class A misdemeanor State told Court that all of Mr Bradshaw’s cases have been resolved including this one and District Court will hear Mr Bradshaw's guilty pleas on October 21st — Stanford F Johnson was not in Court for his Morion for Order of Expungement State offered no objection to the motion and Court granted the petition - Sherrell K Zitting was not in Court for his Motion for Mistrial and Appeal Defendant called asking for continuance Judge stated that Mr Zitting has "attempted to pull this Court around on his chain long enough and I deny his motion and won’t have to hear any more of his motions because I am going out of rotation” - Jerry Todd Wilkins was not in Court for his Waiver Hearing mi charges of Theft a 2nd degree felony State had received a phone call from an attorney representing Mr Wilkins and matter was continued to November 5th Tina L Simmons appeared for a Waiver Hearing on charges of 1) 2 counts of forgery of a check a 2nd degree felony 2) Theft a class A misdemeanor and 3) Theft a 3rd degree felony State told Court that this case will be dismissed in a plea bargain and will file amended information in District Court Terry E Brown appeared for Waiver Hearing on charges of Theft a 2nd degree felony Matter was continued for preliminary hearing on November 19th McLean Aaron Man son appeared for a Waiver Hearing on charges of 1) Possession of marijuana with intent to distribute a 3rd degree felony 2) Possession of drug paraphernalia a class B misdemeanor 3) Underage possession andor consumption of alcohol a class B misdemeanor 4) Speeding a class C misdemeanor Court was advised that parries had agreed to a pica bargain Count was amended to Simple possesa class B misde sion of marijuana frnrTTr ItoffL ti meanor and Count 2 was dismissed in exchange for guilt pleas to 1) 3) and 4) Court sentenced defendant to Statutory limits: $1000 fine and six months in M Hard County j ai on count and $ 5 00 fine and 90 days in jail for count 3 Court then stayed all jail terms and all but $250 fine on 1) and $50 fine on 3) and $50 fine on 4) Defendant was placed on 12 months unsupervised probation - James Braum Harvey appeared for a Waiver Hearing on charges of 1) Possession of marijuana with intent to distribute a 3rd degree felony 2) Possession of drug paraphernalia a class B misdemeanor 3) Underage possession andor consumption of alcohol a class B misdemeanor Court was advised that parties had agreed to a plea bargain Count was amended to Simple possession of marijuana a class B misdemeanor and Count 2 was dismissed in exchange for guilt pleas to 1) and 3) Court sentenced defendant to Statutory limits: $1000 fine and six months in Millard County jail on count and $500 fine and 90 days in jail for count 3 Court then stayed all jail terms and all but $250 fine on ) and $50 fine on 3) Defendant was placed on 12 months unsupervised probation - Armando Q Casarez appeared for a Waiver Hearing on charges of Unlawful sexual intercourse a 3rd degree felony Matter was continued to preliminary hearing on November 5 th Joseph A Goodwin represented trial on charges of himself in a 1) Failure to report an accident a class A misdemeanor 2) Leaving the scene of a C misdemeanor 3) class accident an Improper backing a class C misdemeanor After several witnesses testified for both parties Court determined that the “full nature of Mr Goodwin’s defense is that Mrs Goodwin was the driver State left out charges against her and charges of obstructing justice You can expect your wife to be charged very shortly” stated the Judge before dismissing without prejudice - Colby Hansen appeared for a preliminary hearing on charges of 1) Possession of marijuana with intent to distribute a 3rd degree felony 2) Possesa class B sion of drug paraphernalia misdemeanor 3) Underage possession and consumption of alcohol a class C and 4) Unlawful purmisdemeanor chase of alcohol (false ID) a class C State told Court that misdemeanor matter had been resolved and Slate amended Count to Simple possession of marijuana a class B misdemeanor Counts 2 and 3 were dismissed Defendant was sentenced to $1000 fine and six months in Millard County jail on each offense Court then stayed all but $300 and $75 on Counts and 4 respectively Defendant was placed on 12 months unsupervised probation - Gary Lynn Rawlinson appeared for a preliminary hearing on charges of Aggravated assault a 3rd degree felony Court heard testimony from Spencer Butler and found that the components of the case amounted to the charge Matter was continued to November 4th for trial - Frank Raymond O’Neel did not appear in Court for a preliminary hearing on charges of Aggravated sexual abuse of a child a 1st degree felony State presented motion for dismissal to Court - Tina L Simmons appeared for Preliminary Hearing on three separate cases with charges of Distribution of meth a 2nd degree felony (67) Distribution of cocaine a 2nd degree Felony (68) and 1) Possession of controlled substance cocaine a 3rd degree felony and 2) Possession of drug paraphernalia a class B misdemeanor (77) Court was advised by the State that defendant will face on count of Possession of cocaine (77) in District Court In exchange for her guilty plea all other charges will be dismissed Matter was bound over to District Court for Arraignment on November 4th Gena M Wood appeared for Preliminary Hearing on two chases with charges of Distribution of Cocaine a 2nd degree felony (68) and 1) Possession of a controlled substance cocaine a 3rd degree felony and 2) Possession of a class B misdedrug paraphernalia meanor (77) Court was advised that an agreement has been made wherein 77 will be dismissed and 68 will be amended to Simple Possession of cocaine a 3rd degree felony in exchange for guil ty pi ea M atter w as boun d over to District Court for arraignment on November 4 th Several civil matters were also heard Millard County Chronicle Progress October rAMiMLlfeaa 21 1993 Page 3 page Kathy Poulson testified that Elizabeth Fullmer approached her with the fabrication that Mr Anderson contacted her only to be a character witness for him if needed Furthermore Mrs Poulson said she was unaware of any abuse that existed between the two Will Fullmer testified that his w as very upset after the newspaper account of her testimony at the March trial was published “She told me not to believe everything I read in the Fullmer “She was Mr said paper” afraid of Lester" Mr Fullmer testified adding that she didn't elaborate on the reasons why until she was removed from the home by Sheriffs Deputies Mr Fullmer testified he overheard one of the threatening phone calls stating that "Elizabeth Fullmer is dead” Mr Carter called Mrs Fullmer's testimony “spiteful retaliation against Mr Anderson" who admitted that he was seeing other women while he was seeing her and that her recantation of her story was motivated by jealousy Mr Anderson took the stand and verified this theory He testified that he and she had been having an affair since August of 1992 that after she moved in with him in February he became suspicious of her telling “little lies" “1 gave her the benefit of the doubt" said Mr Anderson “But as time drew on learned she was an habitual liar" He said she must have developed the false account all on her own as she heard him tell others “50 or 60 times what happened She knew it well” he said Mr Anderson said he never threatened Mrs Fullmer or her children "In Playing by the rules On the court of playing field referees and officials oversee the rules of the game and code of sportsmanship Players and teams are penalized for breeches in acceptable behavior But who referees the hunter? With only a handful of conservation officers afield most sportsmen and women arc faced with the responsibility of policing themselves As a whole hunters do a good job there remain a few Unfortunately who need some coaching They may pepper road signs with bird shot or leave a trail of litter Gates may be left open Wounded and crippled animals may be left fact they liked me” he said adding that he was like a father to them keeping them during weekdays the two lived together He also testified that the voice reettrded on the threatening phone call “sounded like her brother's” Mr Anderson staled that Mrs Fullmer flew into jealous rages conLisa fronting his other girlfriend Johnson Ferguson with a gun and shooting into the staircase Mr Anderson admitted to owning “basic hunting guns" and that he had never shot a gun inappropriately "Do you recall in 1991 shooting a shotgun into a mobile home?" asked Attorney Eyre “Yes I did that" admitted Mr Anderson (Mr Anderson had been charged with aggravated assault in 1992 and criminal mischief in 1991 but both cases had been plea bargained to misdemeanors and therefore were not admissible in court ) Mr Anderson si:d that at the time of his trial he knew that Mrs Fullmer was ly ing about her account “You knew she was lying and you permitted it? You called her? Isn't that what perjury is? lie knowingly?"
