for the Tribune wanted the subpoena quashed But on Friday Sept 15 the court announced it had decided against the motion to quash Jorgensen was ordered to present his notes in a deposition Oci 10 The Tribune is expected to appeal Archuleta’s public defender Michael Esplin had said that depending on the judges’ rulings he may request the supression of some evidence He said whether to request a change of venue may also be influenced by the courts decisions October 16 has been reserve d for Esplin to make any such motions Millard County Attorney Warren Peterson concerned the media case was impeding preparation for the Archuleta case also endorsed the trial delay parties agreed to the delay Baliif said the delay was warranted becaub “there have been so many twiata and turn with regard to the media" As this goes to press Judges Baliif and Park have not ruled on a motion by media lawyers to release the transcript of the defendants preliminary hearings The held in January and proceedings March were closed to the public on the order of Millard County Justice of the Peace Ron Hare The closure order was bound over to District Court Since the preliminary hearings were held jointly for Wood and Archuleta Judges Park and Baliif both sat on the bench for the media request to delay When the decision Archuleta’s trial was made the court had not decided on another media matter Prosecutors issued an investigative subpoena for an like to explain th current situation of the East and West Millard Hospital District The two Hospital District in Millard County are not in th hospital business The Hospital in Fillmore and Delta are privately owned and operated and have not been built with tax dollars When the responsibility for Hospital Services was taken over by the private sector the remaining problem that needed some tax subsidy was the long term care of the elderly and disabled In Delta this problem was handled by the remodeling of the old West Millard Hospital into a 36 bed king In Fillmore the term facility problem was handled by contracting with Intermountain Health Care for the use of ten hospital beds in the Fillmore Medical Center for long term care patient At time the ten beds in the Fillmore Medical Center have not been sufficient for the demand so there have been a many a a eight to ten East Millard residents housed at the West Millard Care Center The only function served by the East and West Millard Hospital District are the rehabilitation and care of their extended care patient Each Hospital District now is contracting separately with Inter mountain Health Care for management services at the respective facilities Each District must prepare a budget pay for an audit and submit reports to the County and State Auditor Each District must set a tax levy and hold separate legally noticed public meetings Administratively there is a senseless duplication of management and paperwork with this present system Since both Districts do exactly the same thing (care for the elderly and disabled it makes a lot of sense to combine the administra- The County Agent by Lurry Campbell LhV Extension Agent “Spinning Straw into option you can use to cheaper a ration Straw normally has a TDN of 45 and CP of 4 The anhydrous amonia breaks down the lignin in the cell wall making it more digestible We can raise TDN to 55 protein require a tax rate of 000158 or 79 mill to rain th combined budget of $26300000 This means that a homeowner with a $60000 value in West Millard would pay $318 more each year in taxes but a homeowner with a $60000 value in East Millard would pay $4632 lea each year This huge reduction in taxes is a result of spreading IPP value This is a concept that has been warmly received by the Intermountain Power Association The annexation of new territory into a service district is fairly This year the Mosquito common Abatement District here in Millard County annexed th Leamington area into it boundaries Several years ago the Millard County Fire District annexed Fillmore and Kanosh into it boundaries Before annexation may take place the voders in the proposed area of annexation must agree to pay taxes to the district they want to join This is why the people if East Millard must vote to voice their approval of paying taxes to a new entity The West Millard residents don’t need to vote bees use they already voted to authorize taxation years ago If the East Millard voters choose not to pay taxes to the joint district the annexation is aborted There is talk that this special district merger ia the first of there are no many Actually other annexations or merger a being contemplated for other service district in Millard County This proposed annexation ia the ideal type of icebreaker At the same time IPA recognizes the significant benefit it receive from local government and stands ready to continue to pay its fair share for these service The difficulty lie in deter-ining what constitutes IPA’s fair share In 1988 IPA was billed for over $245 million by taxing district in Millard County alone A a nonprofit wholesale supplier of electrical power to many purchasers including many Utah retail utilities IPA must closely monitor all costs including its fees in lieu of property taxes When IPA is billed more than other similarly situated companies or in amount greater than those allowed by Utah law it must seek reductions in these billings IPA and other Specifically large taxpayers such as utilities and mines are currently assessed by the Utah State Tax Commission at values 20 percent higher than commercial and industrial properties assessed by the county This discriminatory practice has been found to violate federal law as applied to railroads operating in Utah and has been challenged by several state assessed taxpayers including IPASimilarly IPA and other are challenging the constitutionality of a recently enacted statute which imposes a statewide levy for the local costs of assessing and collecting property taxes Even In EDITOR Continued from front page MilFillmore & Delta weekdays lard County Asscwor's Office 2nd T hursdav of Month Great Basin Historical Society 7:30 pm meeting September 17 - 23 Utah I arm Safety Week EMI Week September 21 29 West Millard Recreation League registration 9 Volleyball a m - 5 pm Kec Office 81 S Manaruta Delta September 21 North rlern Back to Delta School rnght 7 prn September 22 f ireside “Discovery" Leamington Ward House 7 - 9:30 prn September 23 Lrlhan Wood 73rd and Clyde Holden Culwedding anniversary tural Hall 7 prn Algjc B Swallow 80th birthday open house home of daughter Julie Stephenson 86 West 200 South Fillmore prn In case of in- Statement from THE IPA IPA is assessed by the rather State Tax Commission than by Millard County in 198 8 IPA was billed nearly $12 million the entire twice (over for this levy collection and assessment budget for Millard County) IPA’s excess fees together with over half the collection fees paid by all other Millard County taxpayers were to other then counties around the state Over half of the total amount of IPA’s 1968 fees paid under protest are attributable to these two state wide issues which have been raised by numerous taxpayers in addition to IPA Even if IPA were to withdraw its protest on these issues the legal challenges by the other taxpayers would not be resolved and IPA may atill be entitled to a refund if they are sucthough cessful The balance of IPA’s under protest relates to payment the interpretation of the statute which creates IPA's obligation to pay fees in lieu of property taxes Because these issues are cu rrently in it would be inapproprilitigation ate for me to specifically comment on them at this time It should be noted however that IPA attempted to reach an early resolution of these issue by initiating discussions with local governmen- tal officials including representatives of the school district as early as January of 1988 During these and subsequent discussions IPA proposed a compromise administrative resolution of all issues which would have eliminated the need to make any payments of feet under protest with respect to the IPA specific issues IPA further suggested expedited procedures for resolving any further valuation disputes well before local budgets would be set and IPA’s fee paid Although their initial reactions were enthe local officials subcouraging sequently rejected IPA’s proposals mutual effort to reach a compromise stalled and IPA was told by the local officials in Millard County to pursue formal legal This posture forced proceedings IPA into the unpleasant situation it had foreseen and sought to avoid namely the necessity of paying a portion of its fee under protest in November erf 1988 IPA remains willing to cooperate with school district and other county officials to reach a prompt and equitable resolution of these issues It understands that stability and predictability in th budgetary process are essential for efficient local government At the same time however IPA owes a duty to it purchasers to insure that it pays only it fair share of the costs of local government Reece D Nielsen Chairman Intermountain Power Agency The fastest stock rise in history occured on December hare of Pennzoil went from to 83 10 1985 when William IL Clapper works The Media Man!
