Show Suits against governments plague Millard County as well as rest of state How do you strike a balance between the rights of an individual to sue government and the ability of government to serve all of the people without fear of reprisal? That is the question on the minds of several Millard County governments and Utah Senator Orrin Hatch who has introduced legislation to stem the tide of civil lawsuits against political subdivisions In a Salt Lake City public hearing this week on Hatch's legislation the senator said that costs for insuring against citizen lawsuits have shot up so fast that there are cities in Utah paying as much as 400 percent more for liability coverage insurance companies have canceled policies with several municipalities and there arc other cities who have elected to stop paying the higher premium because they couldn’t afford it Delta City recently felt the sting of citizen lawsuit which cost over $11000 to settle in Federal District Court The city is seeking to recover $179 of that cost but by law they can ask for no more In the suit filed with the federal court in Salt Lake City Delta businessmen George and Michael Van De Vanter ow ners of Triple Quick convenience store claimed their constitutional rights were violated when they were refused a beer sales license when they were considering the purchase of the land where the present Delta now sits because the owners of were later granted the beer sales a license Delta City Attorney Warren Peterson said that the case was turned over to Salt I ake City lawyers who sought and received a Summary Judgement on the case with the stipulation that the case cannot be tried again Attorney Peterson said that even though the city essentially won the case the cost was heavy Delta City is involved in several other federal court cases which could oe equally expensive Mr Peterson said Senator Hatch said that two US Supreme Court decisions in the last five years arc responsible for causing literal havoc for the country’s local governments "There has been a virtual plosion in the number of lawsuits The brought under the current law burdens imposed by these two decisions arc crowding our courtrooms and creasingly costing millions of taxpayeis dollars instead of providing needed services If this trend in “necessary" lawsuits continues our state and Uveal governments will be paranoid to the point of paralysis” he said year A mild spring last year which failresulted ed to kill young grasshoppers in the Utah’s worst grasshopper festation ever recorded with ranchets and farmers posting $54 million in losses compared to $11 million lost in 1984 Edwards said he is especially concerned with the area south and west of Deseret and Oasis which did not get sprayed last year "We will probably need to spray much of the same ground that was sprayed last year but we hope that the program can be expanded so that some of these other areas will get spayed also" he said Farmers and ranchers are waiting to hear what the spraying program will be like this year The Utah egislaturc is just now considering how much should be allocated for the state program Edwards said the federal program is being administered by a new director this year and it is not known what if any changes there will be in that program The Utah Department of Agriculture is asking the legislature for funding for a grasshopper control program again this year In last year’s grasshopper control program 13 million acres of land were sprayed at a total cost of $336 million ederal money is obtained through of the United States Department Agriculture's Animal and Plant Health This Service (APHIS) Inspection money is used to cover the cost of spray ing on federal rangelands and on a basis with state money on state On private rangeland rangelands and federal money provides the landowner Last year's cost was $258 per acre which was much lower than the pected cost of $400 per acre The resulting cost to the private landownei was $86 on rangeland This cost figure does not account for any of the that land owners may have done on their own cropland which was not covered by the cooperative rangeland program It can seasoning your food also contribute to high blood pressure a risk factor for stroke and heart attack It’s a habit you can't afford not to shake American Heart -
