JP Court have just watched the news regarding the drug bust in Delta Utah I’d just like to make a few comments guess as a “newer” resident of Delta who has moved here perresent the insinuation that manently the problems here are a result of the influx of newcomers here work in a brought by IPP capacity where see and deal with both The peosegments of the population ple involved in drug and family violence juvenile problems deliquency etc are not just newcomers and their children Yes there are probut blems here as in any community instead of trying to always point a finger of blame in some other direction why not work together to identify and solve these problems have met many fine people here in have grown to the Delta area whom care a great deal about and respect greatly They have made me feel a part of this community and not an “outsider” have also met and dealt with people here who tend to hide their heads in the sand They do not want in any form my involvment Many of us are here and here to stay We are not here to criticize but we do have resources and talents to offer Delta We want to be involved in the in the schools in the government and help with the 5 I’m sure Judge Young’s letter in your column has been read with interest by many readers The Utah Legislature has provided alternative Court systems for our use and for one intend to use the Courts available to promote good and effecin Millard tive law enforcement County of the Utah law in Section Utah Code requires a Justice of the Peace to attend at least one qualifying seminar or training course each calendar year commencing with 1978 Any the required Justice not attending seminars of courses for two consecutive years shall have his certification by the Judicial Council withdrawn Since Justice Young has not comthere is a plied with this requirement serious doubt in my mind as to whether or not he can legally sit as a Justice of the Peace in a criminal case As a prosecutor of criminal cases in do not want to Millard County jeopardize any criminal matter particularly a felony matter by filing the case in Judge Young’s court I believe could raise the any defense attorney issue on appeal and maintain that proceedings in a case before Judge Young otherwise or legally were null and void The argument may not deficient prevail on appeal but the process would and a time consuming be terms as of the Court follows: “Jurisdiction means the inherent power to decide a case whereas “venue” designates the particular county or city in which a Court with jurisdiction may hear and determine the case” Utah Code AnnoSection tated 1953 as amended provides that "The jurisdiction of justice’s courts except as otherwise provided by law shall extend to the limits of the county in which the justice’s court is located” Utah Code AnnotaSection 1953 as amended states ted "Justice’s Courts have concurrent jurisdiction of the following public offenses committed within the counties in which such respective courts are established (1) all Class B and Class C Misdemeanors (2) ” all infractions From these sections we see that there may be several courts that have jurisdiction to hear a criminal We charge filed against a person must then look to venue to determine which or court courts having jurisdiction may hear and determine the case Section Utah Code Annotated 1953 an
