Show i AA 1 111e Salt I Ake OPINION Tribune Sunday June 20 2004 1 Utah Democrat Debunking the myth of the knee-jer- k Republican strategists in the 1980s rarely uttered the name of Democratic gubernatorial candidate Wayne Owens without invoking such adjectives as "Kennedy Democrat" or "Eastern Liberal Establishment Democrat" The idea of course was to paint Owens with the broad brush of National Democratic Party liberalism in the hope that would repel the average Utah voter born ola more Western and therefore 411e conservative bent The constant comparisons to 40 Kennedy and the East prompted a column in The Mil Lake Tribune by I yours truly in which I attempted some humor by imagining a conversation between a Utah Republican and a Utah Democrat PAUL In my mythic setting I had the Republican slurping a chocolate malt while the Democrat was quaffing a beer That column attracted a great letter to the editor from Kent Shearer the witty former chairman of the Utah Republican Party "Paul folly got it wrong" Shearer wrote "During an election year the Ihgnocrat also would be having a chocolate malt and telling the Republican all about the LDS! mission presidencies of Wayne decision until Republican Reagan was elected president and promptly killed the project Matheson pere also fought Carter's plan to derail massive water projects in the West and took the administration to court over an ownership dispute between the state and federal government involving oil shale claims Matheson's Democratic predecessor former Utah Gov Calvin Rampton was a vocal and unaadvocate when George McGovpologetic "pro-lifeern won the Democratic presidential nomination In 1972 and the national party took a solidly "pro choice" stance "I actually got more trouble from my own family for being pro-lifthan 1 ever did from the party" Rampton recalled "I don't remember the national Democratic Party ever trying to tell me what to Owens and Gunn McKay" My memory of that incident gained sharper focus recently during a debate between Republican gubernatorial candidates Jon Huntsman Jr and Nolan Karras Both were asked why the Democratic candidate Scott Matheson Jr would not be 'a good choice for governor Karras rewinded that the national Democratic ' Party's liberal agenda would influence a Matheson administration That argument has been used by Republicans against Democrats for det:ades in Utah and is long overdue for debunking Utah elected officials of both stripes have balked at their national party's line on numerous occasions and even have gone to court against their own party's federal administrations to fight for Utah interests When the current Democratic gubernatorial candidate's father Scott M Matheson was Utah's chief executive he engaged in a public and heated war against the Democratic administration over President Carter's proposal to put an elaborate underground nuclear missile system in the desert Matheson and others fought the Carter administration to a draw delaying a final " r e do" ROM Democratic Utah Congressman Jim Matheson has differed this year from the national party's pomarabortion and same-sesitions on late-terriage while Republican US Sens Orrin hatch and Bob Bennett have not joined their Republican president's call for a constitutional amendment marriage against same-seHatch also has voiced support for more stem-cel- l research a position in direct opposition to that of President George Bush So not only Democrats but Republicans too x Utah-Nevad- a Grant of highway lights cannot be revoked Ili 11 I !MM' has scheduled a Rep Richard Pombo June 28 hearing in St George on the issue of rural roads crossing public lands otherwise known as the RS 2477 road issue Revised Statute 2477 was adopted by Congress In 1866 It provides that "the right of way for construction of highways over public lands not reserved for public uses is hereby granted" In 1976 Congress presumed to revoke this granted right Subsequently federal land managers and public land guardians have objected to certain state road claims They say that these claimed roads were not "mechanically" constructed or that they were not constructed "before 1976" or that they "go nowhere" or that they are impassable to modern passenger cars and therefore cannot be "highways" notwithstanding that In 1866 carrying places between water bodies for canoes were also termed "highways" I suggest to Rep Pombo that these objections to state road claims are speciousand irrelevant and that a radical redirection of the RS 2477 discussion Is in order This redirection concentrates on three heretofore ignored considerations: the literal words of the statute the nature of a grant made by a sovereign and the retained rights of member states in the federal union By the words of the statute it is clear that specific physical roads were not granted Rather the "right" to "construct" roads or "highways" was "granted" We should therefore be debating whether or not the right to build roads remains in the state regardless of the action of Congress in 1976 Opponents would argue that the "right" has d ac al 144 EL PFAFF 2022 Stitches Including Blanket Stitch Mock hand-quil- t 24U1 t stitch Button holes MT rs tv040111"1"1'' built-i- walking foot Hem stitch for crochet and SALE heirloom sewing Needle Threader $799 Other Machines On Sale List Sale PFAFF 15301D1 $929 $599 PFAFF 1016 $209 $179 PFAFF 4260 $449 $199 PFAFF 1524 756 Serger PFAFF 1520 PFAFF 'Patented $799 $499 $699 $299 ZS $399 you look at your payment goes to interest do IS IT?
